Jessica Smallwood,

Hospital officials contacted police to investigate Smallwood because she had a suspicious story.

That's when police found the dead baby in the freezer in the house.

Police say Smallwood did not report the death of the baby, and she is reportedly not cooperating with investigators.

Jessica Smallwood's parents were given custody of the three other children

According to DCF, they've been involved with the family twice before over several years.
 
How could she fathom opening the freezer every time she had to feed the other kids dinner knowing her own child was in there!!! Oh my......I just don't know anymore. And people want to know why I'm such a protective mother and barely even allow my 10 yr old to play in the yard. It's people like this, that's why. Crazy stuff!
 
A toxicology report found there were traces of cocaine in the fetus' system.

It is also not a crime for a fetus to have drugs in their system, the state attorney's office confirms.

The law is meant to protect women, with drugs in their system, who otherwise might be afraid to get prenatal care, the state attorney's office says.

It's been more than 24 hours since Punta Gorda Police served a search warrant at a home on 320 Boca Grande Boulevard Thursday -- the same address where an infant was found in a freezer three years ago. The crime scene tape is gone, but police remain very tight-lipped about what they were searching for. Aside from Punta Gorda Police, the Florida Department of Law Enforcement and the fire department were on scene Thursday...

According to sources close to the family, Smallwood's three children are safe. We're told Smallwood's children are with their biological father. The other child is with another family member.

The Punta Gorda Police Chief tells us no arrests have been made yet. He says they will be releasing more details on the case in the coming days.
 
Maybe the fetus is not guilty of anything with cocaine in its system in Florida. But in Tennessee, if a newborn, fetus, or a pregnant woman tests positive for drugs, mom gets arrested.
