    trial thread: 3/23/2012

New thread for a new day. Please remember the rules

When posting an opinion please remember to use IMO or JMO.

the crown will present its case in chapters:

Chapter 1: The day of the kidnapping. The surveillance video showing Rafferty driving up the street outside Tori's school and McClintic walking Tori up the street. Witnesses from and around Oliver Stephens public school will talk about seeing Tori.
An identification officer will use photographs and maps to show the route from Woodstock to Guelph.
Tori's mother, Tara McDonald, will testify about the frantic hours the family spent looking for Tori.

Chapter 2: Terri-Lynne McClintic. "She was an essential part of all that happened," Gowdey said. "I expect her credibility will be a major issue in this case."

Chapter 3: Guelph -- video surveillance and bank records detailing the events there.

Chapter 4: the Mount Forest death scene, which the jury will visit. "It will be difficult to go to the very place where this happened, I know that, but understanding the crime scene is crucial to understanding the crime," Gowdey said. Photographs, some of them graphic, will be used to explain "exactly how the killing happened."
"Unfortunately it is only through them that you can fully understand (the) evidence," Gowdey said.

Chapter 5: Police interaction with Rafferty.

Chapter 6: The searches of Rafferty and McClintic's residences and the evidence found.

Chapter 7: The Honda Civic. What was found inside.

Chapter 8: Rafferty's connection to the Mount Forest area.

Chapter 9: Comments Rafferty made to friends after April 8. "He had some interesting things to say to other people about Terri-Lynne McClintic and about the kidnapping itself," Gowdey said.

Chapter 10: The May 15 weekend and Rafferty's actions.

Chapter 11: The BlackBerry. The BlackBerry allowed police to track his movements April 8 and after.

Chapter 12: A recap of the surveillance video.

    Salem's warning from last week:
Okay everybody - LISTEN UP! We are not bashing, accusing or blaming Tori's family here. It won't be allowed.
Children walk home from school every day without incident. Parents are not perfect, it's just not possible. Tori's parents DID NOT do this to her. TLM and an accomplice DID. That is where the blame goes.
We had a lot of family bashing in the early parts of this investigation after Tori went missing and a lot of baseless accusations - NONE OF WHICH PROVED TO BE TRUE. Victim and family bashing will not be allowed during this trial.
    Thank you,
    Salem

"I was just doing what I was told to do," she said about snatching Tori off the street outside her school.

"What you chose to do," Derstine said.

"What I was told to do. . ." she retorted.

"It's not really your fault you took Tori because somebody else made you," he continued later in the exchange.

"I did what I did. I'm not the only guilty party here, and that is why I am sitting here today," McClintic said.

McClintic's most dramatic counterattack came about two-thirds through the day in a speech about April 8, 2009.

"When I woke up April 8, I never had murder on my mind. I did not plan on kidnapping a little girl. Later on that day when I walked down the street with that little girl, I did not think I was walking her to her death and I sure as hell didn't think it would be my hands that took her life," she said in tears The day seemed like the trial of McClintic, not Rafferty, and Justice Thomas Heeney had to remind jurors that questions and suggestions aren't evidence unless a witness accepts them as truth.

For TM and RS there will always be life before Tori was murdered and life after Tori was murdered; how DOES one cope with that. How DOES one find enjoyment in life after a tragedy like that without every experience colored by that horrible event. It should not be possible that another human being has the power to be able to do that to another human being let alone what was done to that precious girl. Ho hum but yet it has happened.

Kudos to the professionals who dedicate their lives to finding justice for the victims and for their families. It must exact an unmeasurable toll on them on top of the pride they must feel being able to bring justice to them.
    As always, JMO

Prayers for Jun Lin, his family and those that love him.

Wishing the family of Victoria Stafford warm wishes and hoping they stay strong with their courage today. It must be so extremely difficult to bear witness to this trial.

Hopefully, they draw comfort from an angel above.

The defence will continue its cross-examination of Terri-Lynne McClintic today. She pleaded guilty to the first-degree murder of Tori in April 2010. Yesterday, lawyer Dirk Derstine suggested McClintic was the "engine" behind the death of the eight-year-old girl, pointing to a history of violent incidents.

McClintic testified last week that she delivered the fatal blows in a fit of rage on April 8, 2009, but maintains that the abduction of Tori was directed by Rafferty.

Court is scheduled to resume at 10 a.m.

Cross-examination of Terri-Lynne McClintic continues. Rafferty's defence lawyer, Dirk Derstine, is playing songs she listened to by Necro

One Necro song has a chorus: "I got a garbage bag with your name written on it." (Necro is a hip-hop artist with lyrics about torture.)

The defence is playing another song by death rapper Necro. It is called Garbage Bag and it describes a violent murder and the chorus says that there is a garbage bag with your "name written on it." The lyrics are similar to McClintic's letters written when she was in a youth facility during 2007 and 2008, which described the hypothetical torture and murder of a person.

Derstine plays another song called Dead Body Disposal and Derstine suggests the lyrics are similar to McClintic's writings. She agrees and says she had Necro on her iPod around the time of Tori's disappearance. McClintic says she listened to the artist when she was angry.

Rafferty is peering intently at the lyrics of the songs as the defence continues to play more.

McClintic isn't sure if she listened to the latest song when Tori went missing. Derstine reminds her about her Facebook page.

New song includes lyric "Nothing like a dead pastor, splattered all over concrete like plaster"

Also... "You'll live as long as I let you." McClintic sighs when the song ends. Says she posted it on Facebook.

Other Necro songs played in the courtroom: "Eat ***** and Die", "No Remorse".

Plays another Necro song. Lyrics give instructions of how to dispose of a dead body

McClintic says she wasn't listening to Necro. She says she did not have the intention of walking a child to her death.
