The Suwannee County Grand Jury was empaneled this morning (5/11) and they returned a three count indictment charging Anthony Michael Ortiz with (1) First Degree Murder while armed (firearm), (2) Home Invasion Robbery While Armed, and (3) Tampering with Evidence for the April 28th murder of Charles David Napier in Suwannee County, according to State Attorney Skip Jarvis.

Judge Williams accepted the indictment, ordered a capias issued, and ordered that Ortiz be held without bond.

But for the man deputies say did it, this isn't his first run-in with the law. Last year 1-3-11, Live Oak Police pegged Ortiz as the trigger-man in another fatal shooting. Police say Ortiz shot and killed 47-year-old Robert Koester during a drug deal gone bad inside the home of Ortiz's father.

Police say Koester attacked Ortiz's father and that's when Ortiz shot and killed Koester.

But a Grand Jury found Ortiz acted in self-defense and he was never indicted. It's news that has hit some of Napier's colleagues at the Atlantis Salon hard.

49-year-old Napier was found dead by his family in his home Sunday (4/29).
Friends say he had two adult children and was the caretaker for his mother.

Daughtry says, "Always had positive things to say, willing to help any and everybody out."

Suwannee County Sheriff Deputies say Napier lived with his mother who was out of town with family over the weekend. When they came home they found Napier dead with multiple gun shot wounds.
