CA - Girl, 9, assaulted in bedroom by intruder

A convicted sex offender broke into a San Francisco home in the Ingleside district and raped a 9-year-old girl in her bedroom in an hourlong attack that ended when the girl's mother walked into the room, San Francisco police said.

The man, police say, fled on foot and was chased by the girl's father, who at one point struck him with a 2-by-4. The man continued fleeing through several backyards and was captured by police and identified as Roberto Gamero, 36, of San Francisco, police said.

"It's a parent's worst nightmare,'' said San Francisco police Deputy Chief Morris Tabak of Sunday's attack. "It's pretty horrific. All of us who are parents, it sends chills up your spine.''

Gamero, a prior sex offender who was on probation for an earlier domestic violence case in San Mateo County, now faces charges of aggravated sexual assault of a child, child molestation, false imprisonment and burglary stemming from the attack, which shocked veteran investigators.

"This is truly a horrific crime,'' said Assistant District Attorney Linda Moore of the sex assault unit. "We're trying to protect the family at this point.''

Gamero is jailed on a probation hold and $1 million bail. He is scheduled to be arraigned today. If convicted of all charges, Gamero could face a sentence of 25 years to life, said Debbie Mesloh, spokeswoman for District Attorney Kamala Harris.

It was 7:45 a.m. Sunday when the victim's mother heard noises and entered her daughter's room in the Silver Avenue home and found her child with the suspect, who was nude. He apparently entered an unlocked window of the home, police say.

The victim later told police that she was awakened to find a stranger in her bed and recounted an ordeal that lasted an hour in which she was raped and forced to engage in sex acts.

When she resisted his demands, he asked her if she wanted him to be "mean, '' which she understood to be a threat, authorities said.

No jury on earth would have convicted the parents of this girl for murdering him. He deserves nothing less than that!

This poor child could have been exposed to sexual disease--for her sake I hope this man doesn't have any STDs or HIV.

Man pleads not guilty to raping 9-year-old girl inside her home
Judge orders him to give blood to test for sexual diseases
Jaxon Van Derbeken, Chronicle Staff Writer
    Friday, December 10, 2004
A 36-year-old San Francisco man accused of raping a 9-year-old girl in her home denied the charges Thursday, and his attorney objected to a judge's order allowing blood to be taken from the defendant to test for sexually transmitted diseases.

Roberto Gamero, through his attorney, pleaded not guilty to "any and all allegations'' stemming from the alleged attack Sunday at a home on Silver Avenue. He is set to return to court Tuesday. --->>

The father chased the naked attacker out of the house and through the neighborhood, hitting him at one point with a 2-by-4....
Police eventually found Gamero hiding in a bush and arrested him.

On Thursday, over the objection of Gamero's public defender, Superior Court Judge Newton Lam ordered that Gamero submit to blood tests to determine whether he has HIV or other infectious diseases. --->>

Assistant District Attorney Linda Moore said such tests were of the "utmost concern,'' given the nature of the crime and the potential exposure of a 9-year-old girl who had already been forced to undergo a "serious regimen'' of treatment after the assault. --->>

Gamero, who has lived in San Francisco for several years, does not have a criminal history of child molestation. He was convicted of sexual battery of an adult in 1992 in San Mateo, but the law did not require him to register as a sex offender, authorities said.

He was given nine months in the county jail and three years' probation, records show. The case reverted to a misdemeanor when he completed probation, authorities said.

Law enforcement officials were puzzled that Gamero had no previous history of child molestation, given the nature of Sunday's alleged attack.

"It is very unusual that someone of this age starts behavior like this,'' said Capt. Marsha Ashe of the police juvenile division. "This is also an extremely unusual crime -- which is fortunate because it's so obviously heinous.''

Last night I was watching a show where there'd been a series of rapes of young girls abducted on their way to school. The rapes stopped and the case went cold. A few years later a man was arrested for sexually assaulting his two young grandsons. It was determined by DNA testing that this man was the same one who'd abducted and raped all those young girls. Although this man had several previous arrests for sexual assault, none of them were with young boys. People change............

I am not sure whether he knew the girl lived in the house and that was his reason for breaking in.. or did he just happen to burglarize this house and happened across the little girl and decided to rape her then.

From what he said to her... the coniving you don't want me to be mean now do you? makes me think he has done this before to other children... he was taking a huge chance stayng for a whole hour in that house, he wasn't in a desperate hurry or anything to get waht he wanted and get the hell out.

Hello everyone! I'm new to this site, I live in Yuma Arizona and I remember a while ago someone entered this little girls bedroom window at night while the parents were having a get together in the living room, this little girl was raped and murdered, the mother found her dead the next day, they never found the killer, I was so scared because I have 4 children, and I had never heard anything like this happening in yuma and so I was so protective of my kids and what made me mad, was that you hardly ever heard it on the news alerting parents about this I mean for things like this to happen in a small community i would at least think they would alert the parents , so what I do is protect my kids and talk to them about the dangers , but people tell me that I'm going to scare, them but I feel that I am doing the right thing=)

BS on this is very unusual?

I read that most pedaphiles never get caught and when they do, several victims have been prior.

What an idiotic statement from law enforcement when these "heinous" crimes have been all too public in the last SEVERAL years.

Westerfield had never been caught before and yet had an entire LIBRARY on file of innocent children being victimized and tortured on his computer for his personal "amusement". Rape starts in the MIND. Then it is only a matter of opportunity for the &^%&( to nail a child.

This is why I am so enraged that CHILD PORNO is treated so trite. Obviously most adults plead "this has never happened before"..to difuse their own consciences such ravages live amongst our children.

There is no confusion here...this man is a PIG.
So many clowns, too few circuses.

Something similar happened to JonBenet Ramsey in 1996 in Boulder, CO, and to another girl who lived in Boulder the following year.

You might want to tune in Dec 18:

Saturday night's edition of CBS' 48 Hours Mystery (9 p.m., CBS 4) will highlight the third in a series of investigative reports about the murder of JonBenet Ramsey, co-produced by Michael Tracey of the University of Colorado Journalism Department.

JonBenet, as the world knows, was found strangled in her Boulder home Dec. 26, 1996.

This film, according to Tracey, looks at new evidence - and a key suspect - based on information uncovered by what Tracey calls "a new team of investigators."

Produced in cooperation with ITV, a major British network, the film also examines an assault on another young girl, who according to the documentary, attended the same dance studio as did 6-year-old JonBenet.

How horrible!!!! That poor little girl. I'm glad they caught the guy though.

As for Jonbenet Ramsey, I personally believe there was NO intruder. If you want a good read, pick up the book Steve Thomas wrote.

Luvbeaches, you still might be interested in the coverage of "...an assault on another young girl, who according to the documentary, attended the same dance studio as did 6-year-old JonBenet" which happened a few months later, also in Boulder. In that case, the mother had locked up the house for the night, she and daughter gone to bed in their separate rooms upstairs, and the mother heard a noise which she got up to investigate. She ran into the intruder in the hall, he jumped from an upstairs window to get away. The daughter had been assaulted much as is described of the 9-year-old girl in San Francisco. That Boulder case remains unsolved.

And these aren't the only 2 cases where a child has been assaulted and/or murdered in their own homes by strangers, even with their parents at home. Thank God it's rather rare that this happens, but it does happen.

(I personally believe an intruder was responsible for JonBenét's sexual assault and murder. The male DNA found in her underpants does not belong to her family or to anyone as yet compared to that DNA.)

I don't believe there was an intruder. I also believe the DNA is totally unrelated to the crime. The list of questionable things that happened that morning is way too long for their to be an intruder. I believe the truth will emerge one day, probably through Burke (although I do not believe he was involved).

My hinky-meter went off the minute I heard they called all their friends over to their house, even though the ransom note said, "If you talk to a stray dog, we'll behead your daughter." Then of course the whole thing with scooting Burke off without allowing him to talk to the police. I'd allow the authorities to question my child just in case he heard something, which would lead the police to my child. Of course you can toss in all their inconsistant statements, and there you go. This is just the tip of the iceberg as to why I believe they know more than they are telling. And where are they today? What are they doing to try and locate the killer of their daughter?
