JEFFERSON CITY, Mo. (AP) — The Missouri Supreme Court on Tuesday overturned the murder conviction of a man who had been sentenced to life in prison for the 1990 slaying of a neighboring farmer, ruling that prosecutors withheld evidence that may have benefited his defense.

The state's high court ordered Mark Woodworth released within 60 days of when its ruling is finalized, unless prosecutors decide to retry him. Woodworth was convicted of fatally shooting Catherine Robertson and wounding her husband, Lyndel Robertson, as they slept in their home near Chillicothe, about 90 miles north of Kansas City..................

Appeals court agrees to keep out key evidence in 1990 Chillicothe murder case

A state appeals court decided Tuesday against overruling a judge’s decision excluding crucial evidence from a 1990 Chillicothe, Mo., murder case, dealing a blow to the long-running prosecution.

Mark Woodworth, 38, faces a third trial for the killing of Cathy Robertson in November 1990. His two previous convictions were overturned, most recently by the Missouri Supreme Court in January. Along the way, Woodworth, who maintains his innocence, had spent almost two decades in prison.

Thursday a witness gave a sworn statement she saw Brandon Hagan pull up next to her about 10:30 p.m. the night of the shooting. Hagan was known as Brandon Thomure at the time. He's the victim's daughter's ex-boyfriend and the two were said to have a "tumultuous" relationship.
Hagan's mother and sister have testified he was with them in Independence, MO, the night of the murder.
The witness said in her statement she told investigators about the sighting in 1990, but nobody ever followed up with her.

Not that I've read a lot about this case, but it sounds like another one where LE and the prosecutors decided who was guilty and never looked for evidence that didn't support their theory. And, it appears there is a lot of tomfoolery has gone on with evidence. We should expect more from our justice system.
 
At this moment the 3rd trial of Mark Woodworth is still set to begin Monday, July 21st.

Members of murder victim Cathy Robertson's family have been named as defendents, as well as officials. This will be hard for them.
