Jury selection for the trial of Dzhokhar Tsarnaev, accused in the Boston Marathon attacks, begins Monday. Those chosen from a pool of about 1,200 will decide whether Tsarnaev planned and carried out the twin bombings that killed three people and injured more than 260 near the finish line of the race on April 15, 2013. If they find him guilty, they will decide whether he should be put to death.

Seating a qualified jury will be difficult, court watchers say, and could take weeks. It's as important as anything that might happen in the courtroom after jurors take their seats.

"This jury selection process is going to be like very few others in a federal criminal case," said Jeremy Sternberg, a former federal prosecutor who is a partner at Holland & Knight in Boston. "It's going to take a very long time. ... Its importance cannot be overstated."

The terrorism trial of Dzhokhar Tsarnaev will not be getting underway next week -- and a new start date is impossible to set as jury selection drags on, federal court officials announced this morning.

The elimination process is not public until it’s over, but two things are clear: the selection process is behind schedule, and the court may have to take a flexible approach to the standards of impartiality in order to seat a jury.

O’Toole has said he wants testimony to start next week, and it is unclear whether he will meet that goal. With jury selection entering its eighth day today, 61 people have been interviewed. It remains unclear if there are enough acceptable candidates to seat 12 deliberating jurors and six alternates, or how many more will have to be interviewed.

During a final pretrial hearing Monday, Tsarnaev attorney William Fick objected to the plan to bring pieces of the boat to court and suggested instead that the boat be brought to the courthouse so the jury can see the entire boat.
He argued that the jury would be seeing the writing out of context if the panels were brought into the courtroom. To see the whole boat would allow the jury to imagine Tsarnaev lying inside 'much like someone lying in a crypt making those writings,' Fick said.

'Everybody was screaming for help': Marathon bombing survivors testify

More than 250 others were injured. And the first day of the trial -- after opening statements -- revolved around a number of survivors of the attack, who recounted in detail the chaos of that day. Prosecutors called them to the stand to paint a picture of the havoc and pain the bombings inflicted. Tsarnaev's attorneys chose not to cross-examine any of the survivors.
