There have been at least five hung juries in the death-penalty phase of cases in Maricopa County since a 2002 U.S. Supreme Court ruling that juries and not judges should determine if there are sufficient reasons, called aggravating factors, to sentence a murderer to death.

If the jury cannot reach a decision in the penalty phase, the state has the right to ask for a new jury, which it did in four of the cases.

In three of those, the new jury gave death. In one, the defendant got life after two juries reached hung decisions. In the other, the state decided not to ask for a new jury.

Reading this list, I still think we are missing something. Is it that 4 people don't realise just how evil the CM is? Is it they bought some of the DT's story we never expected they'd believe? Or maybe the decision comes down to something that means even if the Jury knew all of the above, for some other reason 4 people still think she deserves LWOP.

Of course I realise they have convicted her of M1, they have found the cruelty so maybe it's nothing to do with this and they really do believe something in that mitigation.

I really feel that a jury should be allowed to know about the character of a defendant. It does have a bearing on the actions being judged. In the murder case I served on as a juror we did find the man guilty, but it was a difficult decision. After trial I did some searching to see what I could find out about this man. I was stunned to find that he had an arrest record going back for at least twenty years. All I could think of was that I was glad we convicted him, because he was dangerous. His demeanor in the court was very calm. He did not look like somebody that had a temper, but when sering his prior arrests it was obvious that he did. If we had come back with a ng verdict, who knows how soon he would have hurt another person. He is now serving a life sentence. I also learned that our case was originally a death penalty case, but the dp was removed the morning of jury selection.

Well SA has made sure to get the word out that she was in fact in the area and close-by, but she claims that the court rep told her it was a jury question and the jury would not even be brought into the courtroom. So she claims she didn't know she was supposed to be there.

I kind of believe her because she has been there every day, so why would she choose that day not to be there?

It's weird. Assuming the family had been told a verdict was in and it was just the public and media who hadn't, could they have guessed the verdict would be as it is because the media hadn't announced a verdict? Even if they thought it was just a question, why weren't they there? They had to have known a decision was imminent, many had expected it the day earlier.

I just want to say that yesterday when I heard a Verdict of NO VERDICT was reached..

I was STUNNED, SHOCKED & DEVASTATED for the Alexander family! I had to walk away from the threads I couldn't take knowing that there was no end to this horrific situation.

I saw the couple mins interview with the Jury Foreman.. interesting but I feel it wasn't really an interview but just a 4 min national podium to let him tell the nation 'Look we couldn't agree, we know what she did was terrible, we know his family is in pain but it was hard for us to look at this woman & put her to death'..

HOWEVER.. I'd like to hear from the jurors after they've seen some of the things they weren't able to see during the trial & get their perspective maybe an interview where they are shown the clip of "Geesh Jodi you could have at least put on makeup" or "This jury betrayed me" and maybe clips of a few of Travis's friends indicating all the stalker behavior that wasn't allowed in court because..

I'm wondering if that would change their view on this case to how we feel because WE are looking at this with ALL the info not with cherry picked items from both sides. JMO

I've mentioned this a few times, but remember that some people are just incapable of understanding what "reasonable doubt" means. They can't wrap their heads around the idea that it doesn't mean "beyond any doubt", and that even though you might come up with a ridiculously unlikely and convoluted alternative theory, you haven't established a reason not to convict.

When it comes to reasonable doubt, I'm always reminded of Alice's Restaurant:

...we got a phone call from Officer Obie. He said,
"Kid, we found your name on a envelope at the bottom of a half a
ton of garbage and I just wanted to know if you had any
information about it".

And I said, "Yes sir, Officer Obie, I cannot tell a lie. I put
that envelope under that garbage."
 
I believe a lot of the abuse claims and other claims by the defense can be brought up in the new phase because they were considered mitigating factors. I have heard this from several sources....am I wrong?

After pondering and getting over my initial shock of the mistrial, I will not be upset if Arias gets LWOP. I was adamant about her getting the DP, but after thinking on it for many hours I believe in my heart she will get the DP even if a jury doesn't sentence her to it.

Let me explain....

I remember years ago when I was living in Milwaukee and Jeffery Dahmer was sent to jail, I told my co-workers at lunch break that he will be killed in jail. I just knew it and I know it will happen to this murderer.

She is not a likable person although she thinks she is. She will not be able to manipulate, manipulators she will not be able to con, cons. But she will try and that will be her biggest mistake.

Perhaps she will get the same type of death penalty she inflicted on poor sweet Travis. Instead of quietly going to sleep someone will show her how she hurt and tortured Travis, without even knowing it.

Then she will truly wish she had been put on death row.

There is no doubt in my mind she will get the death penalty, even if she gets sentenced to LWOP.
