Police: Disabled Pa. man who died suffered neglect

SCRANTON, Pa. (AP) — A 32-year-old Pennsylvania man with Down syndrome was so severely neglected by his family that his body was covered in scabies and he weighed just 69 pounds when he died, police said in charging his mother and two sisters with murder.

Robert Gensiak had open sores down to the bone at the time of his death March 20. He was taken to the hospital a day earlier because he was only semi-responsive and couldn't stand up.

Susan Gensiak, 59, of Taylor in northeastern Pennsylvania, and her daughters, Joan, 35, and Rebekah, 24, were charged Wednesday with third-degree murder, involuntary manslaughter and neglect of care for a dependent person.

Investigators said the suspects told police they were concerned about losing his government assistance if he had been placed in a personal care facility, and his mother asked them if she would still receive her son's Social Security check even after his death.

The suspects had little to say at their arraignments or outside court. It wasn't immediately clear whether they had attorneys, and a phone listing was unavailable.

Autopsy photos showed Robert Gensiak's skin was yellow and laced with scabies bites, with open sores all over his body that were so extreme in spots that bone was visible. His few remaining teeth were about to fall out, his head was covered in lice, and there was no food or significant fluid in his stomach, according to an autopsy.

It was there his family kept him from doctors, even when his skin cracked and bled and open sores formed from being forced to stay in his child-sized bed covered in feces

And it was there the 32-year-old Taylor man with Down syndrome wasted away to 69 pounds because, according to police, his mother and sisters were starving him to death.

That's what tipped me over the edge when I read about it yesterday. She's not sorry she starved and tortured her son, she's sorry her little gravy train is gone. Is there an emoticon here for kicking someone off the planet?

RIP Robert. I am so, so sorry you didn't know the love and care of a real mother. But your suffering has ended, your torturers will face justice.
 
My amazing daughter with DS is 10 years old.
She weighs 62 pounds and is not overweight. :tears:

These girls have children and one is pregnant.
NO mention of their son/brother's life OR death on any of their facebooks.
No obituary or pictures of Robert anywhere either.
Their father died in December 2010.

I hope they never, ever get to be alone with children or the disabled ever again. :stormingmad:

On March 25, police and Children and Youth officials took Joan Gensiak's 2-year-old daughter, fearing her well-being because the home was riddled with scabies, lice and possibly ringworm.

The toddler is in custody with Lackawanna County's Children and Youth Services.
Rebekah Gensiak is roughly eight months pregnant.

All three were arraigned before Magisterial District Judge Paul J. Ware on Wednesday afternoon after their arrest and were sent to Lackawanna County Prison.
Joan and Rebekah Gensiak are held in lieu of $250,000 straight bail. Susan Gensiak is held in lieu of $350,000 straight bail.

Preliminary hearings are scheduled for the three on June 26 at 11 a.m.

I'm gonna throw up. Not because of the descriptions of this poor mans' wounds, but because his "family" did this to him!

They say that they didn't have transportation to take him to the dr, yet on 2 of those facebook pages, they say they are employed, and one of them is studying criminal justice!! They had to have some type of transportation to go to their jobs.
The other states that she is a stay-at-home mom. Now we know how she afforded that!

Kudos to LE, because if it had been me sitting across from this woman, I would've been all over her like white on rice when she asked if she would still recieve his check, even though he's dead!

This is horrifying. I'm so upset by this.
 
No transportation? Really? Cuz I am pretty dang sure they have these things call AMBULANCES that come to the house and get the patient. Believe me, I know because I am a first responder and we deal with people who call for petty crap such as nose bleeds, cramps, a hurt finger and those who really have no apparent issue but want a ride to the hospital, No one is ever refused.

This poor man had to have suffered so much and was helpless and these "unusual people" took money intended to care for him and lived off of it and starved and abused him. Meanwhile, as they serve time, they have a right to be treated better than they ever treated the man they neglected to death.

OMG!!!!!!! This is HEART BREAKING!!!! WHY DIDN'T ANYONE - even the NEIGHBORS who are speaking up now - WHY didn't they report this family or CALL Police when Bobby was suffering or before had to die!!!!! OMG...this is so unbelievably sad on so many levels! That poor man!!!! My heart just bleeds! He suffered for sooooo long! RIP Bobby!!! I'm so sorry your weren't loved like you so deserved!!! You are in Heaven now. You are out of pain...and you are LOVED!!!
 
I think what they meant to say was We didn't request transportation for our fatally malnourished, scabies and lice riddled, bed sore covered son... because that would have prompted some awkward questions. Now where do we cash this SS check?

So glad the little two year old was removed to (presumably) a safer environment. I pray she didn't actually see her uncle in his condition or hear his cries (for surely he must have cried). I also hope she is in good health and not suffering from parasites.

Would it not have been possible for those other relatives to put in an anonymous call to Child Welfare?
 
Of course, anyone could have called to report it. But they didn't. I'd like to know what their excuse is. :furious:

The preliminary hearing for a Taylor mom and her two daughters accused of criminally neglecting to death a close family member with Down syndrome was rescheduled Wednesday so the court can finish appointing their lawyers.

A new date has not yet been scheduled.

Reaction has been overwhelming. Yet I wonder when we, as a commonwealth with an infrastructure to respond to allegations of abuse, neglect, exploitation and abandonment of children and the elderly, will finally say, "Enough is enough." When will we finally implement a protective services program for adults with disabilities so that people like Robert Gensiak do not have to die at the hands of family caregivers who were ill-equipped to render proper care?

In September 2003 the Legislative Budget and Finance Committee issued the "Assessment of the Need for an Adult Protective Services Program." This report examined the need for a protective services program for physically and cognitively impaired adults between 18 and 59.

A FORMER primary school principal remains on bail despite admitting to starving her disabled daughter to death.

Kyla Puhle, 27, was severely emaciated and weighed just 12kg when she died.

Her father died by a gun shot injury after. It has been established that he was licenced to have a firearm. Moo to this as there are no current links.

The last two years of Robert Gensiak's life were worth about $25,000, payable in monthly installments of $1,042.

His mother and sisters spent the money on rent and food while their son and brother went hungry. As he starved to death in a soiled bed built for a child, Robert was eaten alive.

A young man with Down syndrome is totally dependent on his mother and sisters for his daily care. They lock him away in a back bedroom and starve him while spending his disability checks. It's clear he is suffering and won't survive long, but they let him rot for two years, calling an ambulance only after it's too late.

Robert Gensiak did not fall through a crack in a system that is supposed to protect society's vulnerable.

He fell through a chasm.

Though it is not a regulatory agency that directly monitors or investigates complaints of abuse, The ARC Northeastern Pennsylvania aids people with intellectual disabilities and would report abuse to the proper authorities if its staff suspected any, said Donald Broderick, the ARC's executive director. The family never sought their help, Broderick said.

"We did not know the situation until we heard about it like everybody else (this week)," he said. "He was not known to us. It's pathetic, it's appalling. You can't believe something like this would happen today."

Despite the lack of a social services agency that investigates abuse, Broderick said the existing system could have worked if the family wanted help or if someone reported Robert Gensiak's abuse.

"I feel very confident that the system would have responded had they reached out," he said.


Jarbola said the Gensiaks seem to have successfully avoided the social services system. Their frequent moves to new homes could have contributed to being able to avoid getting too close to people who might have noticed problems, he said.

On Tuesday, the Arc of Northeast Pennsylvania dedicated a plaque to Robert in front of its Meadow Avenue facility. It reads: “Robert Gensiak, 2013, Every voice shall be heard.”

“We felt so bad for Robert,” Arc Executive Director Don Broderick said. “He didn’t have a voice in life, and we wanted to give him one in death. He suffered tremendously at the hands of his family”...

He is survived by his mother, Susan Gensiak, 60, who is serving 10 to 20 years in state prison. A sister, Joan, 36, got five to 10 years for a neglect charge and one to five years for endangering the welfare of a child. Her daughter, Robert’s niece, was also infested with scabies. Another sister, Rebekah, 25, testified against her mother and sister and was sentenced to six to 23 months in Lackawanna County Prison.
