McKinney testifies that gate surveillance camera at Retreat at Twin Lakes wasn't functioning night of shooting. Clubhouse camera was.

He said it looked like a lawn mower had run over them..attorneys looking at something on computer.

Judge asking defense if there are any objections, no.

Mantei on direct to McKinney...he wants to talk about 2 cameras in particular.
Looking a arial view of clubhouse. McKinney says one camera in kitchen faces toward front, Retread View street. East cam faces mailbox. One camera in hall faces front door. Plays tape for a while.

He no longer lives there, graduate of FSU.

Asking questions about location of apt. and blinds on porch, always closed, including over sliding glass door.
What was he and wife doing that night? watching tv...did hear noices outside? yes, coming from back yard, doesn't know direction, was faint noise.

2nd time was louder, could not tell if 1 or 2 individuals, he got up went to sliding door and peaked through blinds (vertical), looked like someone or something out there. Wife him not to go outside, he opened blinds and door. (laughter) Wife was on phone. He took one step outside, looked like a tussle, thought might be a dog attack. They were vertical to him, he yelled out what's going on, stop it. Took a few seconds. The 2 did not say anything then.

He could tell there were 2 people not on sidewalk, seconds later the 2 people changed position and he could tell the person on bottom had lighter skin color, face up and person on top straddling them. Then thought it was serious.
Person on top striking person on bottom, did not hear any loud strike. He hollered out to them, cut it out, heard a 'help', not sure which person it was. Just one 'help'. Then they moved up on the sidewalk. He said, I'm calling 911.

John Good, direct:

When you stepped out did you see anyone else outside (besides the 2)? didn't notice.

Playing his 911 call...shot has just happened...says, oh my God, operator says others are calling, someone will be out. He sees flashlights.

Person on bottom not moving, darker skin..goes to picture of where his unit was and his backyard. Was dark and wet outside, raining off and on.

Did you see the person on top slamming the person on bottom into the concrete? no

OM cross of John Good:

Going over what he said about hearing noises and going out to sliding door. When you first looked out at 2nd noise what did you see? couldn't tell, reason he opened door and took a look.

Can he agree that vertical means they were standing up? yes
Horizontal means they were laying down? yes

They were laying on the ground, backwards toward me, but facing downward. Then they went to sidewalk. Person on bottom still downward, and other straddling him. OM demonstrates, he agrees. They were on the cement at the time. 10secs., so quick all happened.

Tell me about the struggle..when he walked out, only saw one person, then saw 2 people and arms moving but could not tell if strikes, then moved to sidewalk, and person on top straddling. He thought person on top was 'ground and pounding' person on bottom. Top position is the dominant position. He now knows this was TM. Saw them from side, when he saw arms going downward and knew serious and went to call 911.

Do you think person on bottom was the one yelling for help? That is logical to me.

Was not 2 voices yelling, not that he personally heard. Person on top, he IDs as TM, did not stop what he was doing when he called out for them to stop. Did GZ have a gun? not that he saw....he didn't watch long enough to see if GZ was trying to get up.

(as usual defense going back and forth in story and trying to get witness confused...not working with this one)

Bill S....when OM was talking to witness about TM straddling GZ, in that person the one on the bottom could have possibly retuned the blows and gotten out of the bottom...a great gift to the state...GZ could have gotten out from underneath and sets circumstances of was it necessary to use lethal force...not in fear for his life...now GZ as to take the stand to justify lethal force...if this is the best the defense has to prove 'fear of life' , not good enough, also people were out and calling 911 and he knew that help was on the way....GZ has to justify that the only way he could survive was to shoot TM...what we've heard so far is that GZ accosted TM and started fight...

Manalo's wife has previous testified. Both are neighbors near struggle/shooting.

Now going over pictures of area where incident happened and his apt. and asking about lighting, etc.

He was the first outside and before police arrived.
