I think there are miles between making a mistake and gross negligence and child endangerment.

A mistake is thinking you turned the oven off, but accidentally leaving it on. Or locking yourself out of the house when you're baby's inside. Or misreading TSP for TBS when giving your child Tylenol.

How does one mistakenly let a strange man escort their daughter to a fitting room twice?

Because somehow I don't think that he was like, "Hey let me take your kid alone into this fitting room. Did I mention that I'm a convicted child molester and on the sex offender registry???"

People like DS are master manipulators. It's how otherwise competent people end up as victims. They make you doubt all of your instincts.

No random stranger should be allowed to take your child anywhere, on the SO registry or not.
People who are murderous sickos don't generally advertize the fact.

She said she got a creepy vibe from him so more reason to be alert and not let your child to go off in the dark of the night to fetch you a cheeseburger with a creepy stranger.

If that is competent parenting I don't want to know what incompetent parenting is.

Just wanted to respond to this quote from the last thread:

It is exactly because one can never know who is a predator/means us harm/ and who is not a predator that it is child endangerment/neglect to hand your child off to a stranger.

---
The crime of Child Neglect occurs when a caregiver willfully or by culpable negligence fails to:
1.Provide a child with the care, supervision, and services necessary to maintain the child's physical and mental health that a prudent person would consider essential for the well-being of the child; or
2.Make a reasonable effort to protect a child from abuse, neglect, or exploitation by another person.
A child is defined as any person under the age of 18 and a caregiver is defined as a parent, adult household member, or other person responsible for the child's welfare.

Neglect of a child may be based on repeated conduct or on a single incident or omission that results in, or could reasonably be expected to result in, serious physical or mental injury, or a substantial risk of death, to a child.
---

Has anyone on this board ever sent their child away to a changing room with a man they just met two hours before?

By her own (now and finally) admissions (in MSM, yes), upon being "promised a gift card at Walmart," the woman:

*Put herself and her three children in a van with a "stranger," a van with the seat removed, the passenger seat reclined, and blinds on the windows

*Spent hours in Walmart shopping with this man

*Allowed him to take her daughter to the dressing room twice

*Allowed her eight-year-old daughter to go with the man (by her own 11th hour admission) off the premises "to McDonald's," with her own personal order having been given

And all the while after the fact the woman keeps throwing in "well he looked sort of creepy's" and "I told him I was nervouses" like that's supposed to explain and excuse her total disregard for the safety and well-being of her child.

Anything short of the perp dangling a shiny silver object in front of her and saying, "Look into my eyes...you are getting sleepy...very sleepy..." is NOT manipulation. This is dangerous, reckless behavior on the part of the mother. It's not "poor choices," it's not "mistakes," it's dangerous, reckless behavior which put three minor children entrusted in her care in the worst of harm's way. I don't care if the man came up dressed like Jesus Christ himself and said, "Suffer the little children to come unto me," she should have said, "I wasn't born yesterday...show me a miracle!"

This woman's dangerous, reckless behavior continues. The two little children continue to live in that house under her control.

I just wonder if in this story the word "mother" was replaced with "nanny" or "babysitter" whether all the "poor choicers" out there would still be talking about this woman's "mistakes." I doubt it.

I think we all can agree that RP hadn't made the decisions she did, her daughter would be alive today. I'm sure she knows that, too.

I'd like to concentrate on the perv for a change. Who is he, really? How did he do so many things that we know of and pay such little consequence? Who is his family? Who does his family know? Who pulled the strings for him to get out and offend over and over? And HTH was he able to live .02 miles from a middle school? How many victims are there we don't know about?

i have been known to not allow my teenagers to go get a burger with their friends... this case is just heartbreaking. i had hopes that we would have some action by now... I'm wondering if negligence charges will be brought? where is AP? one thing is certain, RP enjoys the spotlight, i am sure there will be another article soon...

I second that. Change RP to babysitter and no one would be calling this a mistake.

I do agree that DS was/is a manipulator and a skilled predator. I do believe that he could read people and picked RP out at that Dollar General not only because she had 3 little girls with her.. I think he calculated the risk of being allowed to go through with it and felt confident that he could succeed. I don't think any of us here who are flabbergasted and angry about this case are trying to lesson Donald Smith's role. Ultimately he murdered Cherish. For the sake of justice and the children in Florida, I hope he never hears those cell doors unlock again as long as his evil heart is beating.

I'm not of the camp who believe RP knew what awaited Cherish when she met DS but I do believe her poor choices caused a domino effect.
So many times we can discuss cases and its a stranger abduction that happened in the blink of an eye and short of keeping your child locked inside all day every day you can't avoid the risk.. This wasn't like that, IMO. This was preventable several times. Several.

I am so glad a couple of posts from the previous threads were brought up. I tried to post before it closed, but I lost my whole post because the thread closed.

I have came very close to not following this case because of some of the things that have been said about Cherish's mom. I am only still following it because I want to see justice done in this case.

We don't know anything about her parenting skills. It is easy to criticize someone's poor judgment after the fact. Personally, I am going to reserve judgment until I see something come from LE or MSN that spells out the truth.

If you want to bash someone, bash the piece of trash that did this to Cherish or our system that allowed him to be out among our children to begin with. There is something wrong with a system that allowed a child to be murdered before he is locked up. There were plenty of signs and because of his "rights" he wasn't locked up and already put away. This is what failed...our system. Something has to be changed now.

This mother is grieving and emotionally distraught. Can you imagine being in her position. I raised three children and two were girls, I shudder to think what I would be like if something like this would have happened to one of them. I have a 8 year old grand daughter and I worry every day about this kind of thing. It is out there and they live amongst us. It doesn't matter whether you are poor or rich every child is vulnerable. It is a shame when you can't allow your son or daughter to ride their bikes or play outside because you don't know who is lurking nearby. IMO

794.065 Unlawful place of residence for persons convicted of certain sex offenses.--

(1) It is unlawful for any person who has been convicted of a violation of s. 794.011, s. 800.04, s. 827.071, or s. 847.0145, regardless of whether adjudication has been withheld, in which the victim of the offense was less than 16 years of age, to reside within 1,000 feet of any school, day care center, park, or playground.
http://offender.fdle.state.fl.us/offender/FloridaLaws.jsp#794.065

If the 0.2 miles is an exact distance it's technically legal, it's a little over 1,000 ft.

Personally I don't think it matters too much where they live, it gives a totally false sense of security, because most of these creeps are completely mobile and totally able to walk or drive far more than 1,000 ft from their home to go wherever they want to go to offend.

Edit: the sections that are mentioned here are
794.011 Sexual battery, excluding 794.011(10).
800.04 Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age.
827.071 Sexual performance by a child; penalties.
847.0145 Selling or buying of minors; penalties.

was he convicted of these?

At best, RP has diminished mental capabilities that do not allow her mind to see the possible consequences of her actions .. and this is a BIG worry (to me) as she continues to have the custody and care of two small children.

At worst, RP knowingly behaved in an unacceptable and risky (by reasonable standards) manner, putting herself and others in possible danger, all for a $100 gift card .. and this, too, is a BIG worry to me due to those two small children in her continued care.

We are talking about a 45 year-old mother of 4 who has, no doubt, seen a thing or two in her life – not a young babysitter who made a really dumb mistake.

Yes, it certainly is broken.

However, her daughter was not playing outside or riding her bike. She was shopping with her mom. She was put in a van with a strange man, by her mom. She was allowed to shop for HOURS with a man that was "creepy," by her mom. She was allowed to go to a dressing room with a man that was "creepy," by her mom. She was allowed to walk away with a "creepy" man, by her mom. She was not reported missing for 20 + minutes, by her mom.

There HAS to be discussion about what her mom did. Other parents must learn from what she did. Our system did fail. None of us will disagree with that. We are horrified by the failure of the system. We can't ignore, that the system isn't the only thing that failed. The mother failed. She failed to use common sense. She failed to listen to her instincts. She failed to keep her daughter close. She failed to keep her safe from harm. She failed to keep her other children safe from harm. She failed in the most basic of parental ways. To not allow you children to go somewhere with a creepy stranger. We DO know something about her parenting skills. We know that she allows her daughters to be put in danger, multiple times.

I don't know about anyone else, but I have plenty of outrage to go around. The system is responsible for letting him out and not protecting society. The monster is responsible for his evil. The mother is responsible for facilitating his evil. All get my outrage. All hold responsibility in the death of a beautiful child. All should be punished.

BBM This same dangerous and reckless behavior is one we see to frequently here.Usually the mom is a single woman and the predator is the one she allows to move in her home before she knows him longer then a few weeks.Thats why I do not buy Stranger danger does not happen as often,if you added the parent who meets someone and within a few weeks or even months either does not notice the abuse or looks pasted it till a child dies ,maybe those perps should be included as stranger danger.Even if the perps like DS got life for any offense to a child, what about those ones who are out there who have never been caught or just getting the nerve to begin looking for a victim.Parents have to keep their guard up and any who are like this one ,should not be in charge of a child let alone 3.People are watching out now but that will end and they will return back to their own lives and quite frankly neither parent in that household should have children who are too young to protect themselves. They both think they did nothing wrong. He did not look for them, that alone shows where his judgement is at!JMO MOO
CPS and Family Court also failed this child but the biggest failure was the 4 hours her mother failed her. That could have been prevented had the Family Court realized her bad judgement should not have been blamed on being poor, which is what I believe the mom fearing losing what she got in way of Child support blamed her ineptness as a parent on.Of course I left her stranded at school but gee I do not have a car so It is not my fault or I sent her to school in a taxi and could not afford to go a second time.so on etc. They need to be accountable if not for that judge,Cherish would be alive right now.HAd a father truly had rights but even more importantly what about Cherish's right?

From that article:
"She said she had a conversation with Cherish a week before her disappearance about never leaving any store with a stranger."

That's what good, responsible parents tell their children. But when you have that conversation and a week later Mommy is leaving Dollar General with a stranger AND bringing her kids along... How do you expect an 8yr old to grasp the concept??

That article had a few new pieces of information. RP claims DS didn't go INTO the dressing room with Cherish, that he handed things to her over the door. I know there was a lot of into/to the dressing room discussion.

And the burial. WOW. That changes things for me in a big way. I hope JSO is looking at any other missing children from times he wasn't in prison. Cherish could be his 1st murder victim but any old cases they have deserve another look-see. I am so, so, so glad that the person who lives near the church called JSO!!! So glad. I believe without that tip, we would still be having this discussion in the Missing forum. He would have never told where she was, IMO.
