    Ugh - this bit just got me.

    If only the door had been locked...maybe Kelsall would have gone away.....

    Kelsall is now on Morgan's doorstep. After knocking twice, the second time much more loudly, he tries the door handle, perhaps with his shirtsleeve covering his hand; it's either been accidentally left unlocked or not secured properly.

    Kelsall didn’t appear in court today when the matter was mentioned and a hearing date of August 21 was fixed.

    A BABY-FACED apprentice chef sentenced to at least 30 years for the stabbing murder of Neutral Bay businessman Morgan Huxley has appealed his sentence with his lawyer describing it as “crushing”.

    Daniel Jack Kelsall, 24, won’t get out of jail until he is at least in his 50s for the murder of the much-loved 31-year-old with the sentencing judge saying it was a “chilling” and “senseless” crime by a “very disturbed individual”.

    His lawyer Braddon Hughes SC argued in the Court of Criminal Appeal that the 30 years and three months non-parole period “tied the hands of the parole board” and did not allow them to “reward” the applicant if his mental health improved along with his prospects of rehabilitation.

    The CCA reserved its decision

    Ms Dowling said there was no evidence to suggest Kelsall’s mental health will improve and in fact one psychiatrist described him as having “psychopathic traits and an incipient personality disorder” which are both incurable.

    Ms Dowling said an affidavit Kelsall provided to the hearing also expressed no remorse for his crime.
    “There has never been any expression of remorse or even empathy for the deceased or his family,” she said.

    ‘Convicted murderer Daniel Jack Kelsall is expected to find out whether his 30-year sentence is likely to be reduced on appeal.

    Kelsall was sentenced in 2015 after being found guilty of indecently assaulting and murdering Morgan Huxley, 31, at his Neutral Bay flat in the early hours of September 8, 2013.

    The 24-year-old's lawyer Braddon Hughes SC told the NSW Court of Criminal Appeal in August the sentencing judge erred in his assessment of the killer's prospects of rehabilitation.

    Justice Robert Allan Hulme said the murder must have been "the doing of a very disturbed mind" when he jailed the former kitchen hand to 40 years and three months with a non-parole period of 30 years and three months.

    Sally Dowling SC, for the crown, said there was no evidence to support a proposition that he may be diagnosed with a mental condition which could be treated and improve his prospects of rehabilitation.

    "This was, as the sentencing judge observed, a truly heinous, chilling and grotesque example of murder," she said.

    The three appeals judges considered written submissions and are expected to hand down their decision on Friday [6 October 2017].’
