ANDERSON, Ind. — An attorney for convicted murderer Fredrick Michael Baer pleaded for his client’s life today, saying that if jurors recommended the death penalty they would be saying Baer “doesn’t deserve to live.”

Attorney Jeff Lockwood told jurors he sought not sympathy for his client but acknowledgement of the factors that led to Baer slashing the throat of Cory Clark and her four-year-old daughter, Jenna, in their home near Lapel in February 2004.

Authorities are seeking the death penalty for Baer, who was convicted last week of two counts of murder.

Lockwood added: “You are being asked to condemn a human being.”


Madison County Prosecutor Rodney Cummings, speaking in an interview, acknowledged Baer had a tough life, but said, “So what?” He added that nothing justified what Baer did to the Clarks.

When I read that: I said to myself, he is asking a retorical question?

Not a very bright lawyer to say somthing like that......but once it is out there.........

In making the ruling, the U.S. Court of Appeals cited ineffective legal counsel for failing to object to jury instructions that kept the jury from considering mitigating circumstances and failure to object to instances of prosecutorial misconduct...

Madison County Prosecutor Rodney Cummings said Friday that the case was going to be reversed because of the erroneous jury instruction given by Judge Spencer...

During a 2013 interview with The Herald Bulletin on death row, Baer said he thinks about the case every day and that he deserves to die.

He believes death offers the only release from his constant regret and self-loathing."

"ANDERSON, Ind. (AP) - A man convicted of killing a central Indiana woman and her 4-year-old daughter has been sentenced to life in prison after a federal appeals court threw out his death sentence.

Circuit Judge Mark Dudley sentenced 47-year-old Fredrick Baer of Indianapolis on Thursday to two terms of life without parole for the 2004 slayings of Cory Clark and her 4-year-old daughter Jenna Clark at their rural Madison County home about 25 miles northeast of Indianapolis.

A three-judge panel of the 7th U.S. Circuit Court of Appeals threw out Baer’s death sentence in January 2018, ruling he had received ineffective legal counsel...."
