So I take it this did not take a plea? I thought mom had asked the state to drop the DP if he pled guilty and there was no trial.

Attorneys for Springfield murder suspect Craig Wood argued Thursday the death penalty is unconstitutional.

Judge Thomas Mountjoy said he would take the issue under advisement and make his ruling another day. The case is set for another pre-trial hearing on Aug. 30.

Thursday's hearing was the latest attempt by Wood's attorneys to get the death penalty off the table.
 
Judge considers consequence after Craig Wood stonewalls psychiatrist
Greene County Presiding Judge Thomas Mountjoy said Friday he needs more time to consider how to punish Craig Wood for possibly violating a court order.

Earlier this year, Mountjoy ruled that prosecutors could hire a psychiatrist to interview Wood at the jail.

But when prosecutors flew a doctor in from Boston in July, Wood allegedly refused to answer her questions — citing his fifth amendment rights.

In response, prosecutors filed a motion this summer asking for three things: that Wood's attorneys not be allowed to call their mental health experts as witnesses; that prosecutors be allowed to introduce evidence that Wood failed to comply with the court-ordered examination; and that Wood's attorneys be required to pay the expenses incurred by the psychiatrist (about $7,000).

In a recorded phone conversation with his friend, Wood allegedly laughed about the incident and said that he was following his defense attorney's instructions.

Wood's trial is scheduled to begin at the end of this month, and his attorneys are fighting to keep the jury from seeing what they deem as irrelevant "character evidence."

In a motion filed last week titled "Motion in Limine: Guns, Sex and Drugs," Wood's attorney Patrick Berrigan asked the judge to keep evidence related to the following items found at Wood's home out of the trial: 18 guns, a variety of pornographic videos, baggies containing marijuana and assorted drug paraphernalia.

In a separate motion, also filed last week, Berrigan asks the judge to prevent prosecutors from presenting evidence related to the purple folder seized from Wood's home.

The folder, which has already been the source of some litigation, reportedly contains hand-written fantasies about sexual encounters with minors and yearbook photos of four middle school girls who attended Pleasant View, where Wood worked.

Berrigan wrote that the gun evidence might cause jurors to view Wood as a "'gun crazy,' militaristic, dangerous or unstable."

The public already knows that from following the news. Like the news of how he kidnapped a young girl from the street in front of her house and was found by police a couple hours later, in the basement of his home, raped, butchered and wrapped in plastic garbage bags, while he stood there, alone, covered in evidence, cleaning up the mess with bleach.

His lawyer is trying to get him off with a light sentence that will put him back on the streets in another 10 years, after the publicity has died down. The jury needs to see just how much a monster he is so they will make sure that never happens.

Its wrong that the justice system in Greene County has allowed this monster's attorney to drag this case out for over 3 years, hoping the public will forget the horror he committed. If they rule in the monster's favor on this motion, I'll have serious doubts that the public will ever be safe from this man.

Greene County Prosecutor Dan Patterson confirmed this week that the case against 40-year-old Denny R. Bonar was dismissed without prejudice in June "due to the unavailability of the victim."

Bonar had been charged in October 2015 with felony attempted enticement of a child and sexual misconduct involving a child following allegations of inappropriate behavior with an 11-year-old girl.

He must think he'll be doing well in the upcoming trial. Why not? His attorney is doing a great job for him.

I wonder, does Craig Wood still have his $1 million trust fund to draw from? According to news articles, his insurance policy paid for the wrongful death lawsuit brought by Hailey's parents. He's still a very wealthy man.

After prosecutors paid more than $7,000 to fly in a psychiatrist for a court-ordered mental evaluation, Craig Wood — to the apparent ire of prosecutors — refused to answer her questions.

Wood, the man accused of kidnapping, raping and killing 10-year-old Hailey Owens, also found the court-ordered psychiatrist attractive, court records show.

Partial transcript of the phone conversation Wood had with one of his buddies about refusing to answer the psychiatrist's questions.

Wood: "Yesterday, oh (laughs) yesterday, I didn't tell you about yesterday. The prosecution had their, uh, their psychologist in. So they bring this lady in from the east coast. Fly her in..."

Wood: "Yeah fly her in, some big expert. Well so then they're like we're going to we're going to video tape it. My lawyer is like no you're not, you're not videotaping it.... I was told that if, that all I can answer were what my name was and that I was housed in the Greene County Jail and anything else was, I respectfully decline to answer your question based on my fifth amendment right to not be a a witness against myself. So I did that."

Dishman: "(Wood's attorney) Patrick (Berrigan) told you to say all that..."

Wood: "Oh yeah, they were f---ing pissed, they were f---ing pissed. So she gets up and leaves, comes back in, and she's like just let me just make sure, get this clear and I'm like yup, (laughs) so I told her nope I'm not answering any questions. Oh man, so she wasted all this time, couple of days coming in, you know, they wasted all that money..."

What a despicable man. Can't say much for his friend, either.

I think it will have gavel to gavel coverage from a station there. I will try to find out which one. If you look at the docket entries for Craig M Wood on Casenet.MO you can see all the motions filed and when. There is hardly a day that goes by that does not have motions filed by the Defense. This trial will make others we have followed look like child's play, IMO.

As a reminder this abduction / rape and murder began over 3 1/2 years ago when our basement scanner crew picked it up even before this 10 year old girl's Amber Alert went out, causing much controversy as to what took them so long. This case caused changes to the MO
procedures in the system. The candlelight vigil for her attracted over 10,000 to attend in Springfield, MO. It has been so long that many have forgotten...but we shouldn't.

Possibly we could start a trial thread for this little girl.

Bless your sweet and tender heart, Sin. Just find another case & check in with us as you can. We are getting ready, as always, to go into that "lull" time between the DA building a solid case, S/W's being released to the public, autopsy results, and waiting, waiting for the trial to start. If MO's lag time from arrest to trial is what we usually see, it should be a couple of years before the killer is sentenced...

The only thing that allows me to stay on horrors like this one is my outrage & anger, and then (in most cases) a perverse thrill when the esso bee is convicted. I have to develop and nurse my anger; it is my watch dog to keep the sorrow away. (It not always successful, btw. The tears are always ready to roll down my face. And they always do.)

Don't suffer, Sin, there are other cases, as you know. :therethere:

If I remember correctly the Jury will be selected from a pool from Platte County, MO. I don't know if they will go there for that selection or bring the pool to Greene County. Wish I knew. Platte County is about two hours away I think.

Lawyers tapped a pool of 500 potential jurors from Platte County, north of Kansas City, Lawyers trimmed that pool to about half after asking a series of questions about the death penalty. Then, the court sent out requests to several dozen jurors.
The death penalty remains an option in the case. A judge in September denied a request to throw out the death penalty punishment in the case. His attorneys argued the death penalty is unconstitutional. The judge disagreed.

I hope this goes well. I worry his lawyers are going to try to throw out a lot of red herrings. Was there ever a decision from the judge on the request to throw out info about Wood's *advertiser censored* journal where he wrote about kidnapping and killing young girls? Last I read he was still considering that and the other motion to suppress evidence about his extensive gun and *advertiser censored* collection.

JMO, Wood's attorneys will try to sow doubt that he was the one who did the actual murder. They don't need to find an alternate killer, just create the impression that there was one. Just a suspicion I got from reading some of their arguments to suppress the *advertiser censored* journal.
 
Jury selection begins today — and other details of the Craig Wood trial

Eventually, 16 jurors — including four alternates — will be selected and brought to Greene County for the trial.
The jurors will stay at an undisclosed hotel where deputies will patrol their floor. A deputy must be present when they call their families and jurors are not allowed to leave on their own.
