    Man Vanishes From Clarksburg Home; Family Seeks Answers -

    Clarksburg Police are asking for your help in the search for a missing man. Darrell Lynn Golden, 58, was last seen Sunday night around 6 p.m. before he went for a walk on Locust Avenue in Clarksburg. His sister claims he walked out the door and indicated he would return - but never came back. Darrell's family is highly concerned because his health is declining and he hasn't received his medication since he went missing.

    Chief Deputy Steve Johnson said a man was going fishing near a mine impoundment pond and saw a man's body laying at the edge of the water. The sheriff's department identified the man Friday as Darrell Lynn Golden, 58, who had been reported as missing.

    Tracy Boals Miller, 19, and Shane Andrew Miller, 21, were indicted by grand jurors for murder and conspiracy in connection to the death of Darrell Golden, 57, who was reported missing on March 17. His body was later found in the Margaret community in Harrison County on March 20.

    Golden's body was found near a large water impoundment off of Jones Run, and evidence obtained indicated that Golden's body had been dragged from the roadway to the current location, near the water's edge. The Millers are believed to have beaten Golden with beer bottles, then Shane Miller held Golden's body down while Tracy Miller held his head down in the water until he drowned, according to the complaint.

    The couple left their bloody clothes near the scene and then attempted to wash the inside of Shane Miller's car to remove blood that was inside, according to court documents.

    The criminal complaint said Golden’s disappearance was believed linked to a breaking and entering in Clarksburg that Shane Miller had committed but Golden knew about. Investigators said tips led them to Shane and Tracy Miller after Shane was heard discussing Golden’s death. He was allegedly upset that Golden had talked to police about the crime at the Blue Bird store.

    A 20-year-old Lumberport woman pleaded guilty to voluntary manslaughter Thursday in relation to the March 2014 killing of Darrell Golden, but the judge has yet to accept it...

    Golden's sisters told the court that if they accept this plea, Boals will not serve enough time in prison. The sentence for voluntary manslaughter is three to 15 years, and Boals would be eligible for parole after serving three years and nine months. Judge John Marks decided to defer his ruling on the plea and ordered a pre-sentence investigation...

    Miller will stand trial August 17 for the charges he faces in Golden's death.

    Because the jury granted Miller mercy in finding him guilty of the first-degree murder of Darrell Lynn Golden, the defendant was going to have to wait at least 15 years until he could see the parole board. But now, Miller’s wait might be extended substantially if Romano can prove the defendant has a prior felony conviction...

    Once sentencing is imposed at a later date, Miller will have a limited amount of time to appeal his convictions to the state Supreme Court.

    Harrison Circuit Judge John Lewis Marks Jr. imposed a sentence of life with parole eligibility in 15 years for the defendant’s November conviction by a jury of first-degree murder with mercy.

    Then Marks imposed an additional 2-5 years for the defendant’s other conviction, conspiracy to commit murder...

    Miller’s motive for the murder, according to Harrison Sheriff’s Sgt. Rob Waybright, was to silence Golden about a break-in law enforcement believe Miller committed at a Clarksburg business just days prior to the slaying. Miller was concerned that his probation might be revoked, the state has alleged.

    Attorney files motion for new trial on behalf of convicted murderer

    A Harrison County man serving 17 years to life for murder and conspiracy in a 2014 homicide has temporarily ditched his appeal and a separate challenge of his imprisonment to focus on a motion for a new trial.

    That motion was filed recently for defendant Shane Andrew Miller by Jason Wingfield, a Morgantown attorney who joined the case Sept. 29.

    Wingfield’s filing asserts he has discovered new evidence that could clear his client of both counts.

    Additionally, Wingfield’s motion lambastes the handling of the case by Miller’s trial attorney. A study of the history of the trial appears to indicated Miller received ineffective assistance from counsel, Wingfield asserts.
