CA - Jailed teen charged in rape of cellmate, 13, May 2005
A 16-year-old boy being held in Alameda County Juvenile Hall for an Oakland homicide was charged Friday with raping his 13-year-old cellmate in a crime that a county official said may have resulted from overcrowding.
The county district attorney's office charged the boy with two counts of oral copulation, one count of sodomy and one count of assault for an attack over two days at the youth facility in San Leandro, prosecutor Jon Thurston said Friday.
The boy, whose name is being withheld because of his age, was arraigned in juvenile court Friday afternoon. The alleged victim, whose crime was not revealed, has been placed in a group home.
The first alleged assault took place about 10 p.m. on May 12 and the second at 6 a.m. on May 13, authorities said.
The 13-year-old didn't scream, cry out or say anything about the assaults until the evening of May 13, when he told a staff member, said Chief Probation Officer Don Blevins, who heads Juvenile Hall. Employees are required to check the cells every 15 minutes.
The county sheriff's office was called to investigate the allegations and took both boys to Highland Hospital, where physical evidence appeared to show that the assault claims were true.
There wasn't anything that suggested he had a behavior problem, and he had no prior history of sex offenses," Blevins said. "In hindsight, it might not have been the best decision."
