A WOMAN was slain in broad daylight just hours after going to court over an intervention order concerning the man now accused of her murder.

Fiona Warzywoda, 33, was stabbed to death outside her solicitor’s office on Wednesday, shortly after leaving court.

Her de facto, Craig McDermott, 38, faced court on Thursday charged with her murder

Magistrate Peter Reardon on Thursday granted the Herald Sun permission to report the existence of an intervention order between Ms Warzywoda and her former partner.

He refused an application on behalf of Chief Commissioner Ken Lay to suppress this, saying the matter should not be hidden

A CHILD protection expert has called for tougher family violence laws and a renewed push to convict more men who break intervention orders.

Australian Childhood Foundation chief executive Joe Tucci said changes to the law were needed, to treat family violence as a crime against the state rather than against an individual.

Police are grappling with a big increase in reported family violence, with court figures showing that there has been a 42 per cent increase in intervention orders in the past five years.

Police statistics released earlier this year showed there were 20,418 breaches of intervention orders in 2013, up by 40 per cent from the previous year.

McDermott's lawyer said it was his client's first time in custody and he'd suffered an injury to his hand, which required further treatment.

The court granted permission for McDermott and Ms Warzywoda to be identified publicly despite being the parties to a family violence intervention order, but McDermott's image was suppressed as police still needed to speak to eye witnesses.

McDermott was remanded in custody and ordered to reappear in August.

What would make this tragedy even more tragic would be if we were to separate what happened to Jill from cases of violence against women where the victim knew, had a sexual past with, talked to the perpetrator in a bar, or went home with him,” Mr Meagher said.

“The more I felt the incredible support from the community, the more difficult it was to ignore of the silent majority whose tormentors are not monsters lurking on busy streets, but their friends, acquaintances, husbands, lovers, brothers and fathers,” he said.

Organisers of Tuesday's vigil have encouraged mourners to bring candles and to knit or crochet red hearts in memory of the ''brave woman who died trying to make a safe life for her and her children''.
''Dropping off flowers wasn't enough,'' organiser Sophie Dutertre said. ''As someone who lives in the west and feels a strong attachment to this community, I do not want the death of this woman to be just a news item for a day, and to disappear from our consciousness.

Recent high-profile cases of domestic violence have sparked fury at a lack of action and represent 'the tip of the iceberg' suggests Domestic Violence Victoria CEO, Fiona McCormack.

SARAH FERGUSON, PRESENTER: A peaceful Easter Sunday in the northern suburbs of Melbourne was shattered yesterday by the deaths of two little girls, aged three and four.

The sisters were reportedly killed at their grandmother's home. A 35-year-old man, whom police say was known to the girls, has been charged with their murder. He's believed to be their father.

This attack follows the killing of 11-year old Luke Batty two months ago, beaten to death by his father in front of his mother.

These are the cases that make the news, but there are hundreds of other acts of domestic violence against women and children reported every day

Crown prosecutor Brendan Kissane, QC, in his opening address to the jury, said Mr McDermott and Ms Warzywoda had been together for 18 years and had had four children but their relationship ended in February 2014...

The CCTV footage showed Mr McDermott and his son having a coffee near where Ms Warzywoda had parked her car before he stood up and walked towards her.

There was a confrontation and Ms Warzywoda was stabbed six times – three times in the chest, once in under the chin, once in the shoulder and once to the head... The entire incident took less than a minute.

The murder trial of a man accused of the brutal daylight slaying of his ex-partner has been aborted after their daughter broke down while giving evidence...

Two of the couple’s daughters were to give evidence against their dad, claiming he had warned them that he was going to kill Ms Warzywoda... But after starting to give her evidence, the first of the daughters to testify was deemed unfit to continue...

Discharging the jury, Justice Forrest said it was inappropriate for the trial to continue because Mr McDermott’s lawyers hadn’t had the opportunity to cross examine the girl...

It is expected the trial will now go ahead after Easter next year.

At the trial’s opening, the jury heard Mr McDermott told the eldest of the couple’s children he would kill her mother. The alleged warning came about a month after the couple had split, and just weeks before Ms Warzywoda was killed...

But it was a zombie in a video game that Mr McDermott wanted dead, his barrister John Desmond claimed...

Manuela Galvao told the court two of the alleged killer’s children — aged 10 and 8 — mentioned the threat when interviewed. “He said he was going to kill mum with the pocket knife in the car,’’ one child allegedly told her.
 
THE son of killer Craig McDermott has recalled his step sister trying to jump out of his father’s moving vehicle during a ride she claimed he threatened to kill her mother.

But the man, who was 17 at the time and cannot be named, told the Supreme Court he did not know why.

During recorded evidence played to the jury last week, the 11-year-old told police she attempted to jump out of her father’s car after he threatened to kill her mother with a pocket knife.

Ms Warzywoda, a mother of four, was stabbed six times on a busy street not long after a meeting with her solicitor about their relationship on April 16, 2014.
The victim’s family wept in court at the verdict, saying they were pleased with the outcome.
McDermott had pleaded not guilty to the murder charge, telling his Supreme Court trial that he had acted on the grounds of self-defence.
He also denied purchasing a knife from a nearby shop moments before the stabbing, or ever having a knife.

Fiona Warzywoda: witnesses give account of Sunshine stabbing

A man "rugby-tackled" his partner to the ground as he stabbed her outside a Sunshine shopping centre, a court has heard.
Ian Jones, appearing in court via video link from Tasmania, said he was sitting at a restaurant about 30 metres away with two other people when he heard a woman scream "Help! Help! Help!"
A man appeared from the shops a couple of seconds later, put his arm around her neck and stabbed her in the throat as he pulled her to the ground, Mr Jones said.

There were so many witnesses and yet this 'man' claimed it was self defense and denied buying a knife just before he killed Fiona! Another maniac who couldn't care less about his children or about human life and lies, lies, lies to save himself! :furious:
