IT was an evil and ferocious killing of an 10-month-old baby boy with no explanation.

Harley Hicks used a homemade baton made of copper wire wrapped in tape to bludgeon Zayden Veal-Whitting more than 30 times about the face and head during a burglary spree in Bendigo in June 2012.

Zayden's murder will haunt his mother, 24-year-old Casey Veal, forever.

Defence barrister David Gallowes said Hicks used the drug ice before the murder.

Hicks, of North Bendigo, will be sentenced on a date to be fixed.

During a plea hearing in the Supreme Court in Bendigo, Crown prosecutor Michele Williams said the “cold, calculated killing of a baby’’ in this case was not an act of revenge or self-defence, it was “an evil killing without any real, rational explanation’’.
“We say in the circumstances here … the nature and gravity of the prisoner's crimes are extreme,’’ she said.
“We say this murder may be categorised as a callous murder of an innocent, defenceless baby.
“This killing falls within the worst case category of murders and as such we call for a life sentence.’’
Ms Williams said the fact Zayden sustained at least 25 injuries to his face, eight to his scalp and fractures to his clavicle and rib, and that a weapon was used, suggest “the prisoner was intending to kill Zayden as opposed to cause him really serious injury’’.
“The circumstances in general … of the killing of 10-month-old Zayden we say are such that would shock the conscience of ordinary right minded people,’’ Ms Williams said.

The Crown has called for a life sentence for the man found guilty of the “evil killing’’ of baby Zayden Veal-Whitting.

Ten-month-old Zayden was found bludgeoned to death in his cot by his mother in their Long Gully home on June 15, 2012.

A Supreme Court jury last month found Harley Hicks, 21, of Long Gully, guilty of murdering Zayden with a hand-made baton.

Hicks was out committing a series of burglaries in the Long Gully area overnight on June 14/15, 2012, when he entered Zayden’s Eaglehawk Road home and struck him repeatedly with a baton made of copper wire and electrical tape.

A BURGLAR who beat baby Zayden Veal-Whitting to death and tried to blame the murder on his twin brother will spend at least 32 years in jail.

Harley Hicks, 21, beat 10-month-old Zayden to death in his cot after breaking into the Long Gully home in the early hours of June 15, 2012.

Hicks used a makeshift baton crafted out of copper wire and electrical tape to rain blows upon Zayden in the ice-fuelled frenzy.

A jury found Hicks guilty of murdering the sleeping child, as well as charges of aggravated burglary and theft, following a five-week Supreme Court trial in Bendigo

During the trial his defence lawyer, David Hallowes, suggested Harley’s twin brother, Ashley, could have been the killer because of their identical DNA

There were warrants out for Hicks’s arrest when he consumed a cocktail of alcohol, cannabis and ice and went about burgling homes and stealing from vehicles the night and morning he killed Zayden.

he didn't have to kill zayden, he had a choice, the poor baby didn't
fingers crossed, he will remain in jail although i wish he had a life sentence with no parole

Did the drug ICE cause him to become so mentally disturbed that he made a weapon and bludgeoned a baby 30 times? Did he bring the weapon with him? Did he have any explanation for why he was so threatened by the baby?

Even if the drugs were responsible for his state of mind, trying to blame a twin brother speaks to character ... so it couldn't have just been the drugs.

That must be the ICE, because that doesn't make any sense with a robbery.

Sorry, couldn't you just use his own hand made bat on him? No life sentence? Will he be released later? Ugh... Rest in peace, sweetheart. I'm so sorry I read this. I usually don't read this thread because it make me so angry & the sentences are never harsh enough, jmo

BABY murderer Harley Hicks has lodged an application for leave to appeal his sentence.

The grounds for which he is seeking appeal are:

Ground 1: The applicant's age; the risks to the applicant while in custody in the light of the nature of the offence; the applicant’s likely permanent status as a protection prisoner; the chaotic, abusive and traumatic background against which the applicant’s personality was wrought; the fact that that those chaotic and abusive forces that shaped the applicant’s character were entirely visited upon him by the adult world and not of his making;

Hicks is also arguing the fact that the killing took place without planning but was instead spontaneous and impulsive; the absence of features of vengeance and premeditation that attend the comparable of cases where children are victims of murder.

Ground 2: The learned sentencing Judge erred by aggravating the sentence upon a finding of the absence of remorse.

In sentencing, Justice Kaye said he watched Hicks during the trial and did not detect any sign of remorse, nor the slightest indication by him of any pity or sympathy for the baby whose life he had taken, or those whose lives had been shattered.
 
So, he's blaming the adults in his early life .. What's his twin brother like? Wonder if he is anything like the killer?

I don't think the sentence is long enough!
