Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?

From March 2007:
A motorist enraged at a trucker who supposedly refused to let him merge onto a freeway was given 15 years to life in prison Wednesday for running over and killing his adversary in a roadside dispute.
Marc Grossi, 44, was convicted Feb. 21 of second-degree murder and hit-and-run in the Oct. 9, 2004, death of Jorge Negrete...
Negrete got out of his truck and was standing outside his big rig when Grossi accelerated his pickup -- kicking up a cloud of dust -- and drove into the victim, crushing him against his 18-wheeler, the prosecutor told the jury.
