GUILTY NM - Kenneth Boyd, 23, killed while retrieving his abducted child, 1 Sept 2014

A 24-year-old Albuquerque father was stabbed to death at a gas station while attempting to retrieve his infant son from the car of a man who had earlier driven off with the child, authorities said on Tuesday.

The accused killer, 32-year-old Michael Fox, had offered the child's parents and a female acquaintance a ride home from a party outside of Albuquerque on Monday, then kicked the couple out of the car and drove off with the baby, according to a criminal complaint.

The infant's mother called police, who issued an Amber Alert for the infant as a missing and endangered child, the complaint added.

The witness in the vehicle with Fox said she received a phone call saying an Amber Alert had been issued for Boyd's child. When Fox learned about the alleged Amber Alert, he told the witness he wanted to give the child back.

Fox drove his car to the Target parking lot across from Coronado Mall. As they waited for Boyd and his girlfriend to arrive, the witness said Fox became paranoid and then drove off. They eventually stopped at the Circle K, where Fox got out of the car.

Several witnesses at the scene said the men got into a fight before Fox stabbed Boyd with a knife in the stomach.

Michael Preston Fox, 33, charged with murdering Kenneth Boyd in a series of events that included drinking at a party and taking off in a car with the year-old son of Boyd and his fiancée Krista Ramey, was acquitted of first-degree murder Wednesday.

The 2nd Judicial District Court jury failed to reach agreement on the step-down charge of second-degree murder, two counts of kidnapping and two counts of false imprisonment, but convicted Fox of tampering with evidence, according to District Attorney spokeswoman Kayla Anderson. She said the office will evaluate whether to seek a retrial on the unresolved counts.

An Albuquerque jury Friday found Michael Fox guilty of voluntary manslaughter in connection with the stabbing death of Kenneth Boyd in September 2014.

Fox, 34, had been facing second-degree murder, kidnapping and tampering charges, but the jury only found him guilty of voluntary manslaughter. Jurors began their deliberations Wednesday evening.
