GUILTY OK - Noel Vargas, 4, beaten to death, Turpin, 27 Aug 2014

A mother and her boyfriend are in jail for the death of her 4-year-old son, according to officials...

Yazmani Rodriguez faces first degree murder and child abuse. Silvia Vargas is charged with enabling child abuse.

Authorities say the 4-year-old boy had a large red ligature mark on his neck and many bruises on the rest of his body. He also had what looked like cigarette burns on his legs and hands.

Five other children lived at the home – four brothers and one sister, according to the affidavit... The horrors continued to unfold as agents interviewed Noel’s siblings, two older brothers.

One told agents he was watching a younger sibling in the master bedroom that fateful evening when “… he saw Rodriguez punch Noel three times quickly in the stomach and heard Noel screaming. Rodriguez dragged the boy into the bathroom, which was next to the master bedroom and the brother could “… hear Rodriguez hitting Noel over and over.” The boy added “Noel was screaming in pain”...

Another older brother was also interviewed. He claimed he had been out riding his bike, and when he pulled up to the trailer that evening, “he could hear Noel screaming from the trailer inside” as Rodriguez was beating Noel... Rodriguez then left to pick up Silvia, and after he left, the brother waited a few more minutes to make sure he wasn’t returning and entered the home. The boy stated “… he entered (the boys’ bedroom) and he saw Noel laying flat on his back and not breathing. (He) believed Noel was dead.”

Beaver County, Okla., district attorney Mike Boring said Yasmani Rodriguez of Turpin recently pleaded guilty to one count of murder in the first degree and was sentenced to life without the possibility of parole in the death of Noel Vargas...

Boring said the case for the mother of the child, Silvia Vargas of Turpin, is still ongoing.

The mother of a 4-year-old Turpin, Okla., boy murdered last year pleaded “no contest” Tuesday to a charge of enabling child abuse regarding her connection with the death of her son, Noel Vargas.

After her boyfriend, Yasmani Rodriguez, pleaded guilty recently to one count of first degree murder and was sentenced to life without parole in the case, Silvia Vargas received a 20-year sentence Tuesday in Beaver County, Okla., District Court, with all but six of those years suspended.
