IL - Erin Justice, 16, found murdered, stepdad charged, 27 March 2004
Erin Jenea Justice made a startling accusation two days after her 16th birthday.
The high school track star accused her new stepfather of sexually assaulting her in their Naperville apartment while her mother was away at work.
Instead of making an arrest, authorities opted to wait for results of a lab test to see if a forensic link existed between the stepfather and DNA evidence found on Erin’s body during a hospital examination.
The results were expected back within four weeks.
Erin did not live long enough to hear them.
Valerie Justice found her daughter’s body in a bathroom tub filled with bloody water in their new Aurora townhouse on March 27, 2004 — 24 days after Erin said she had been raped.
Her death is a tragic example of the fallibility of the criminal justice system — a system in which police, prosecutors and state child-welfare investigators make tough calls, often relying on their gut instincts.

Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?
