    OH - Toddler Allegedly Raped by Grandfather

    Forty-nine-year-old Robert Eismon was arrested after the girl's father said his wife found Eismon on top of the girl in the garage during a family picnic.

    Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?

    Maxium? for raping a baby? should be life IMO, he is a danger to all children, there is no cure for being a monster

    Was that in the article linked? The last sentence says:

    If convicted, Eismon could spend the rest of his life in prison.

    I hope he gets life, if they can't give him the death penalty.

    What shocked me the most about this guy is that it happened at a family picnic! I mean this guy was so...so... brazen, or nonchalant, or casual. I don't know what word to use to describe this! He just takes the kid out of sight and does it right at the picnic!

    IF convicted???? I swear that should read WHEN convicted. That's the trouble with law... under certain circumstances there should be no "innocent until proven guilty". I am pretty sure if you walk in and catch some sick monster doing that you should be allowed to do the whole "judge, jury, and executioner" thing right then and there.

    Sentence: 5 years

    Offense: 1st Degree Kidnapping
    Sentence: 10 years

    That's not near enough time. I hope he "expires" in prison, no way should this one ever be released.

    wtf????????????? he got less time for raping her then for kidnapping (what kidnapping btw?)

    this is seriously messed up.

    They considered her inability to leave the garage at will to be kidnapping. Let me go back and make sure I didn't reverse the sentences, just to be on the safe side.

    ETA: I have it right. 5 years on the GSI and 10 years on the kidnapping.

    ok but how is a rape charge considered less then the kidnapping? its a toddler for jeebus sake.

    And on top of that, why would not the rape charge on a toddler alone be worth a good 20 years minimum? Then, in the appeal, the guy had the nerve to fight being put on the child predator list. He says, since he only did it once.....
