    Another husband thinking he can get away with murdering his wife. Heidy Truman had over 875K in life insurance money taken out on her. What gets me is how nice and attentive he was to her in front of others. Sometimes it's love, and sometimes it's a person trying to make the perfect 'set-up' for murder. Thankfully, this time it didn't work!

    For a second time, Conrad Mark Truman was seated at the defense table in Judge Samuel McVey's courtroom on the first day of trial on allegations that he killed his wife in 2012.

    And though the scene is familiar to Truman and others involved in the case, a new panel of jurors was assembled Thursday to hear evidence about the fatal gunshot wound that 25-year-old Heidy Truman suffered inside the couple's Orem home.

    But the question for this jury is the same as during Truman's first trial: Was Heidy Truman murdered at the hands of her husband? Or did she die of a self-inflicted gunshot wound?

    In 2014, a 4th District Court jury convicted now-35-year-old Conrad Truman of first-degree felony murder and second-degree felony obstructing of justice, finding that he held a gun to his wife's head and pulled the trigger on Sept. 30, 2012.

    But months after sending Truman to prison, McVey overturned the conviction last summer and ordered a new trial, finding that the first jury was given incorrect measurements of the Truman's home to consider.

    On Friday afternoon, Colette Dahl, Truman’s sister, and Rachel Wagner, Heidy Truman’s sister-in-law, testified largely of how the untimely death impacted the family ties and how suspicions blossomed into murder charges.

    Dahl has stood by her brother relentlessly from the beginning in 2012. As Sam Pead, deputy Utah County attorney phrased it, she felt “substantially different,” about the outcome of the case than the prosecution.

    Her feelings were fairly obvious, as her interaction with Pead was anything if not heated.
    The tension between the Trumans and Heidy’s family, the Wagners, was palpable. Dahl said a separate obituary had been published with Heidy Truman’s maiden name, Wagner. And every so often, Dahl or her brother would go to Heidy Truman’s grave and find adhesive letters spelling “Wagner” over her last name.

    “They outright accused my brother of taking Heidy’s life,”

    In fact, when people began accusing Truman of involvement in his wife’s death, Dahl became irate and took to Facebook to express her frustration and speculation on what she believed had happened. And Rachel Wagner was not happy about it.

    The two had a long conversation over Facebook about the post, which Wagner felt was in poor taste. Dahl agreed and had deleted the post.

    It's not something that the Utah medical examiner had ever done before in his career: Change the manner of a death from undetermined to homicide and then back to undetermined.

    But that was the case in the autopsy report for 25-year-old Heidy Truman, Edward Leis testified on Tuesday in 4th District Court.

    The deputy chief medical examiner said the woman's cause of death has never changed. She died from a "contact gunshot wound" to the head, Leis testified, meaning someone pressed the muzzle of a gun against her head and fired the weapon.
    Leis' testimony came during the second week of the Conrad Truman's trial. Leis told the jury that he initially ruled Heidy Truman's manner of death as "undetermined."

    After meeting with police and prosecutors and reviewing evidence in November 2012, Leis said he changed the manner of death to homicide. That was the finding presented to the first jury, which found Conrad Truman guilty.

    But Leis testified on Tuesday that he relied on incorrect home measurements — the same measurements that the first jury considered in delivering their guilty verdict — when he made the "homicide" conclusion.

    Mark Moffat discussed several motions before Judge Samuel McVey with the jury removed from the courtroom.

    “Judge, I’m going to argue that [reasonable] evidence simply does not exist in this case,” Moffat said.

    Moffat argued two motions — a motion to suppress evidence and a motion to dismiss charges, based on what the prosecution had presented at this point in the trial.

    Moffat contested that many of the statements Truman made on the night of his wife’s death were admitted unconstitutionally. At some point that night, Truman said, “I can call a lawyer right now. I think I deserve a phone.”

    Because of that, Moffat argued there was not enough viable evidence presented from the state’s witnesses for a reasonable jury to make a conclusion beyond a reasonable doubt whether Truman was guilty or not guilty.

    McVey agreed there were a few weak witnesses, he said the jurors can decide on what evidence may or may not point to a murder conviction at this point.

    “The jury can make that determination,” McVey said.

    After three weeks of testimony from police officers, experts, friends and family, Conrad Truman’s second murder trial is nearing its close.

    Edward Varra, a clinical psychologist specializing in trauma, testified Wednesday about the nature of trauma. Varra testified that trauma is common in experiencing the death of a loved one, though the act of taking a life typically does not constitute trauma. Anger, he said, would not come about as a result of taking a life.

    Angry and hateful emotions exhibited by Truman as police crowded his home and his wife lay dead on the floor were common of trauma victims, Varra said.
    Stephanie Horner, a specialist in gunshot residue testing, then testified to the gunshot residue samples taken from both Conrad and Heidy Truman’s hands.

    The gunshot residue test is significant. Truman asked first responders at the scene to test his hands for samples. Rather than doing so, an officer told him he could wash his hands as they were covered in his wife’s blood.

    Heidy Truman’s right hand was found to have been covered in gunshot residue. Her left hand and both of Conrad Truman’s hands were nearly absent of gunshot residue.

    “The population of gunshot residue on her hands is consistent with her discharging a firearm,” Horner said.

    However, Horner agreed with Sam Pead of the prosecution that gunshot residue testing cannot delineate between if someone fired a gun or was merely in the presence of a gun being fired.
    Lehi Wilkerson, a friend of the Trumans, testified to Heidy Truman’s family relationships and how she often felt left out or unloved.

    “She felt like she wasn’t as loved by her mom as she was by her other siblings,” he said.

    Wilkerson said Heidy Truman resented her mother for never telling her who her biological father was.

    Closing arguments will be heard Thursday morning, after which time the jury will begin deliberations.

    For the second time, an Orem man is waiting while a jury deliberates whether he killed his wife or she somehow shot herself.

    Prosecutors described Thursday how Conrad Truman's temper and disregard for his wife's privacy led him to barge drunk and angry through a locked bathroom door, triggering a confrontation that turned deadly.

    The Orem man's attorney explained Truman's erratic and hostile response to police and first responders as deep trauma from witnessing his wife take her own life.

    But in closing arguments Thursday, both sides agreed it likely will never be known for sure what happened on the night Heidy Truman, 25, died of a gunshot wound to the head.

    During a Utah County's man's second time before a jury, he was acquitted of the 2012 murder of his wife.

    A 4th District Court jury on Friday found Conrad Truman not guilty of first-degree felony murder for the Sept. 30, 2012, shooting death of 25-year-old Heidy Truman at their Orem home — apparently agreeing with defense assertions that the woman committed suicide.

    Truman, 35, also was acquitted of second-degree felony obstructing justice for allegedly giving conflicting information to police about what had happened to his wife.

    “We’re just glad that the truth has finally put this nightmare to an end,” said Colette Dahl, Conrad Truman’s sister. “We’re just really grateful to the jury and to our attorneys.”

    Mark Moffat, Truman’s lead attorney, said he’s grateful his client is a free man after nearly four years of incarceration for a crime of which he has now been acquitted.

    “What people need to understand is that Conrad Truman has been incarcerated since July 2013 for a crime he didn’t commit,” Moffat said. “This is a day long coming.”
    Moffat would not comment on whether a civil suit against the Orem Police Department or the Utah County Attorney’s Office will be filed after Truman’s acquittal.

    “He’s going to spend some time trying to ease back into life on the outside,” Moffat said. “It’s going to be difficult, I’m sure. I think there are challenges for him because he’s been incarcerated for so long.”

    Ann Taliaferro, a member of the defense team, said she hopes Truman finally has a time for mourning.

    “Maybe he’ll get a chance to grieve. He never got that chance,” Taliaferro said.
    Heidy Truman’s family, the Wagners, left the courtroom without comment.

    Tim Taylor, a member of the prosecution, said he respected the verdict and process, though it was not in his team’s favor.

    “Once an individual has been found not guilty, that’s it, there’s nothing that our office can do,” Taylor said. “This case is over with.”
