The death of a 3-year-old Vader (Washington) boy Oct. 5 has been ruled a homicide, and a man and woman who were caring for the child have been arrested and are expected to be charged with homicide by abuse, according to the Lewis County Sheriff’s Office. Brenda Wing, 27, and Danny Wing, 26, both of Vader, were arrested this morning at the Child Protective Services office in Centralia and booked in the Lewis County Jail. The couple had been caring for Jasper Henderling-Warner for several months, according to the sheriff’s office.

On Oct. 5, Brenda Wing called 911 from the 400 block of Main Street in Vader to report that the boy was unconscious and not breathing. Life-saving measures were attempted, but the child was pronounced dead at Providence Centralia Hospital a short time later. According to authorities, the boy had “severe and obvious” bruises and injuries to his entire body. He was with the Wings while his mother had moved to Vancouver, Washington, according to the sheriff’s office...

Detectives interviewed Jasper’s mother, who said she was homeless and couldn’t care for her child. She gave them a note that stated from July 31, 2014, to July 31, 2015, Danny and Brenda Wing were Jasper’s guardians. She said she hadn’t seen her son since mid-September, according to reports.

Ahhhh jeez, what a cutie pie. So they didn't waste any time starting in on the little guy, did they. Mom gave Jasper to them on July 31st and the mom hadn't spoken to them since mid-September. Dad didn't have custody and was apparently not involved in his son's life and Mom was homeless, but it's difficult to believe that Mom would choose to leave her child with this gruesome duo....

Vader City Councilman Kevin Flynn knew something was wrong.

In September, he saw Brenda Wing in a disabled car in front of the Vader Post office, with two children in the back seat. It was the first time he’d met her....Jasper was one of the children...

“You could tell something wasn’t right. … She was totally frazzled. It looked like she was emotionally abused. ... I never saw that little boy again, and he’s the one that was killed,” Flynn said of Wing and 3-year old Jasper Henderling-Warner.

Jasper’s facial expression never changed and looked full of fear, Flynn said of the encounter days before the boy died.

“We brought food and a coffee maker to their house because we had heard they were making coffee out of a dirty sock,” he said.
The Wing’s never let him inside the home, only to the door step.

“(Danny) was off the wall. The first time we went to deliver food, he came out in a threatening tone asking who I was. It always looked like he was strung out on something all the time,” Flynn said.

The couple’s home was piled almost ceiling high with boxes and things. A shed next to the home was stuffed with mattresses, toys and furniture. The grass on the side of the house was nearly knee high.

Oh my God it's even worse than I imagined. This is sickening. He was missing his bottom teeth, they knocked his teeth out! He also had healing broken bones and would fall to the floor, writhing in pain. Those f'rs!! And there was another adult staying with them, an 18-year-old named Zachary Kidder. Who did nothing to help poor Jasper.

No details are offered of exactly what happened, but the results are described in court papers as numerous abrasions including on the back of his head, trauma to his face and multiple bruises to his arms and legs.

X-rays revealed healing fractures, and Jasper was missing his two lower front teeth, according to the court documents.

Things are falling into place. Mom is apparently a drug addict as are the couple she entrusted with her child. Mom also has an online fundraising page to raise money for Jasper's funeral which is still active at this time. Wouldn't he already have been buried? He was killed over a month ago. Maybe they are holding his body?

I hate to say this but giving cash to an (alleged) drug addict is just not a great idea. In a case like this I would encourage people to donate directly to the funeral home.

Ugh and she'd only met the couple a few times before she left Jasper with them!

This reminds me of the girl in Indianapolis in the 1960's where she and her sister were left in the care of a virtual stranger by her traveling carnival parents. One sister was tortured and killed by the women, her children and neighborhood children. Sylvia Likens RIP.

A woman, who was arrested along with her husband for the death of a toddler, will take the stand at her trial, her defense attorney said, after a court hearing where her trial was pushed back one week...

Crowley requested on Thursday in Lewis County Superior Court for the trial to be moved back one week to May 18, which the judge granted. He told reporters the extra week will give him enough time to review an interview the prosecution plans to have in about a week with Brenda Wing’s husband, Danny Wing, who took a plea deal with the state on March 19.

The remains of 3-year-old Jasper Henderling-Warner are still waiting at the Lewis County Coroner’s Office nearly six months after he died, Lewis County Coroner Warren McLeod said on Wednesday.

McLeod on Feb. 11 sued Jasper’s estranged parents, Nikki Warner and Casey Henderling of Vancouver. They agree he should be cremated and to split his ashes, but they cannot agree on a funeral home. Warner wants the funeral home to be in Battle Ground and Henderling wants to use one in Longview, McLeod said.

A trial to decide the matter is set for April 14 in Lewis County Superior Court.

Danny Wing’s sentencing is set for 1:30 p.m. Aug. 14 and Brenda Wing will be sentenced at 1:30 p.m. Aug. 21...

Brenda Wing faces a standard sentencing range of 12 to 16 years. Danny Wing likely faces a shorter sentence, as his plea agreement came before his wife’s and included fewer charges.

New interviews, a failed polygraph test and a phone conversation from jail show a couple awaiting sentencing for manslaughter in the death of 3-year-old Jasper Henderling-Warner lied about vital facts in the case, according to the Lewis County Prosecutor’s Office.

Prosecutor Jonathan Meyer told The Chronicle Monday that his office believes Danny and Brenda Wing violated the terms of their guilty plea agreements, in which they were offered sentences of 12 to 16 years in prison, by lying or omitting facts in statements. Their sentencing hearings are scheduled for Friday in Judge Nelson Hunt’s court.

“We’re going to be asking for significantly higher (sentences),” Meyer said.

A Vader man accused of killing a 3-year-old boy in his care has been sentenced to nearly 35 years in prison.

The Daily News of Longview reports that 26-year-old Danny Wing of Vader was sentenced Friday in Lewis County Superior Court for the death of Jasper Henderling-Warner.

A sentencing hearing has again been delayed for a woman who pleaded guilty to first-degree manslaughter in the death of Vader toddler Jasper Henderling-Warner.

Brenda Wing, 28, was scheduled to be sentenced in Lewis County Superior Court Friday. Her new sentencing date is 1:30 p.m. on Dec. 16.

The sentencing was delayed after her attorney, John Crowley, of Seattle, argued that Wing should have a new polygraph test. Her plea agreement with the Lewis County Prosecutor’s Office stated that she must give complete statements about Henderling-Warner’s death, verified by a polygraph tests. Her first was inconclusive and she failed a second.

December 2015:

Danny Wing, 27, filed a notice of appeal with the Washington State Court of Appeals Division II on Oct. 14...

The Wings’ plea agreements required them to give accurate and complete statements to investigators, verified by polygraph tests, in exchange for sentences of 12 to 16 years.

At Danny Wing’s sentencing in September, prosecutors revealed that he failed the polygraph, and argued that he should therefore receive an exceptional, or much higher, sentence...

Superior Court Judge Nelson Hunt imposed a 416-month, or 34.6 year sentence.

On Thursday, Wing appeared in court with Pascoe as prosecutors formally filed findings of fact, required in cases of exceptional sentences. Wing refused to sign the document.

In October 2014, though, Jasper’s short life came to a painful end. He died from ongoing and severe abuse while in the care of Danny and Brenda Wing of Vader. Warner had placed her son with the couple — who were recovering heroin addicts — at the end of July 2014 while she searched for a job and worked on getting clean.

But Jasper’s life had been harsh from the time of his birth. He was born to teenage parents and moved several times while his mother searched for work or a better living space. According to a Daily News investigation, from 2011 to 2014, Child Protective Services responded to at least 11 complaints about Jasper alleging neglect by his mom. Complaints ranged from accusing Warner of not feeding Jasper to tying him to a chair in front of the television for long periods of time. Others asserted that Jasper was regularly in the presence of drug users, including his parents.

Today, the Wings are each serving 34-year prison sentences for killing Jasper — a punishment that offers little solace to Jasper’s grieving family. Still, big questions remain: Why did the state never remove Jasper from his mother’s care? Did its inaction doom the toddler to an early death?

Danny Wing, the former Vader man sentenced to 34 years in prison for his part in killing three-year-old Jasper Henderling-Warner in 2014, has won an appeal allowing him to withdraw his 2015 guilty plea.

If he does seek a trial, however, he could end up spending even more time behind bars.

A State Court of Appeals ruling, made available Tuesday, agreed with Wing’s lawyer that a technicality made the plea deal invalid.

Danny Wing’s appeal had two parts. The first is based on the requirement in his plea agreement that he provide prosecutors “with truthful information” by taking two polygraph tests. If Wing failed the polygraphs — which he eventually did — the prosecution would be able to supplement the charges with additional “enhancements.”

Wing’s appeal claims that “aggravating factors” were added after his failed polygraph tests. The appeals court rejected this part of his appeal, saying the facts showed Wing understood the consequences of failing the lie detector tests.

However, the appellate court accepted the second part of Wing’s appeal. It contends that his offender score — a rating based on his criminal history — was improperly calculated. Wing’s offender score for his third-degree assault charge was calculated at a 6, rather than a 5.

On Sept. 25, 2015, moments before being sentenced to spend more than 34 years in prison for his confessed role in the death by abuse of a 3-year-old boy, Danny Wing, who was in tears for much of the hearing, emotionally voiced a desire to take back his actions.

“I plan to do what I can with my life … to teach people about drugs and alcohol,” he said at his sentencing hearing, referencing his own heroin addiction during the time of the boy’s death.

A year and a half later, it’s a different story.

“I’m going to pursue my legal defenses,” he said after calling a Chronicle reporter Friday afternoon from prison in Walla Walla.

When asked if he was now denying his role in Jasper Henderling-Warner’s 2014 death, for which he was originally charged with homicide by abuse and pleaded guilty to first-degree manslaughter, Wing backtracked from his confession to prosecutors.

“I would be sorry for that to happen for anybody,” he said. “We’ll have to get into that in a new trial setting.”

“Any confession backed by a failed lie detector test is not a true confession,” he said. “I don’t think that’s the purpose of our phone call at this point.”

Wing said he confessed because he felt helpless, and he blamed his attorney in the case, Todd Pascoe.

“I had little knowledge of my rights. I’m legally blind,” Wing said. “I had no way to do legal research.”

Wing’s wife, Brenda Wing, also pleaded guilty and confessed to her and her husband’s actions that led to Henderling-Warner’s death.

Danny Wing did not answer directly when asked if his wife’s confession was also not legitimate. However, he said he believed she was not adequately served by her defense attorney.

Lewis County Superior Court Judge Andrew Toynbee ruled Friday that Wing will have until Nov. 13 to notify the court in writing of his intent to withdraw his guilty pleas.

“On that day, if he has not filed in writing his withdrawal of (his) guilty plea, I will deem that to be waived,” Toynbee ruled.

If Wing withdraws his guilty pleas, Lewis County Prosecutor Jonathan Meyer previously told The Chronicle his office plans to refile charges and take Wing to trial if need be.

If Wing does not withdraw his pleas, he will be re-sentenced in accordance with the Court of Appeals’ order.

Wing wants a year to make his mind, Beigh said.

The Washington state Court of Appeals will not review Lewis County Superior Court Judge Andrew Toynbee’s October 2017 order that Danny Wing must decide by a set date whether to withdraw his guilty plea in the 2014 death of 3-year-old Jasper Henderling-Warner, as allowed by an earlier Court of Appeals ruling, according to the Lewis County Prosecutor’s Office.

Danny and his wife Brenda Wing were each sentenced to 34 years in prison in 2015 after pleading guilty to first-degree manslaughter and third-degree assault in the toddler’s 2014 death in Vader.

Last year, the state Court of Appeals ruled in each case that the Lewis County Prosecutor’s Office incorrectly calculated the Wings’ offender score, a number based on criminal history that determines a standard sentencing range, affecting the sentence for the third-degree assault charges, but not the manslaughter charge.

Both Danny and Brenda Wing were granted the right to either be resentenced on the charges, or to withdraw their guilty pleas and begin their cases anew.
