Docs: McNary ‘preserved’ clothes, bedding from accused rape

Court documents show the incident happened on Dec. 1, 2014 when McNary forced the victim to submit to sexual intercourse. The documents say that McNary intentionally touched the victim in a “rude, insolent or angry manner,” which resulted in the victim being injured.

Police say they were dispatched to a call around 5:50 a.m. for a woman wanting to report a rape that happened about an hour before the call, according to court documents. The victim told police she was sexually assaulted by an unknown man in an unknown location. The victim told police she was with co-workers when she was at a downtown bar before she later arrived at the unknown man’s apartment.

Colts linebacker Josh McNary has been placed on the commissioner-exempt list, meaning he won't play until his rape case is settled.

McNary went to court Thursday to faces the charges against him. He entered the City-County Building just like any other person, forced to remove his belt during a security check.

Prosecutors say McNary's celebrity status as a Colts linebacker will not affect the case.

NFL puts Josh McNary on Commissioner's Exemption list after rape allegations

The NFL has intervened immediately and taken action against Josh McNary.

In accordance with the NFL’s Personal Conduct Policy, the Indianapolis Colts’ backup linebacker has been placed on the league’s Exempt/Commissioner Permission List pending further notice, according to a league statement.

Joshua McNary case: Whom will jurors believe?

The rape case against Indianapolis Colts linebacker Joshua McNary will likely be decided by 12 jurors asked to determine who is telling the truth: the professional football player or the woman who has accused him of assaulting her after a Colts game.

That's the take of Indianapolis attorney Jack Crawford, a former prosecutor who now works as a defense attorney.

"This is going to be a very close case in my estimation," Crawford said after reviewing the probable cause affidavit that lays out the allegations against McNary.

At issue is whether the jurors will believe that the sex was consensual. Prosecutors argued that although the woman willingly went home with McNary, and the two flirted and kissed throughout the night, she did not consent to having sex with him. The woman testified earlier this week that she said "No" several times and scratched McNary while he raped her in his bedroom.

Defense attorneys said the woman is "confused" and "conflicted," and that her statements about what happened on Dec. 1 have changed repeatedly. McNary testified Wednesday that the woman was friendly, chatty, and fully engaged throughout the night, and that she never said "No" to him.

Ex-Colt Josh McNary found not guilty in rape trial

Former Colts linebacker Josh McNary took the stand in his rape trial on Wednesday to testify that he and his accuser had consensual sex last December and his testimony appears to have been given a lot of credit by the jury in the case.
