    Judge removes DA from Bagnall murder case

    Mercer County Common Pleas Court President Judge Thomas R. Dobson on Monday disqualified District Attorney Miles K. Karson Jr. from the murder trial of Michael D. Bagnall, which was to start today.

    Bagnall is accused in the Feb. 28, 2015, slaying of Jaylen “Bubby” West of Farrell.

    Dobson’s move was fallout from Karson’s relationship with the family of Tonya Bulboff. Defense attorney Stanley T. Booker represents both Bulboff and Bagnall.

    Bulboff is implicating Karson in criminal activity, and her attorney and Bagnall’s are one in the same, Dobson said. That presents a potential conflict of interest, and it could be argued that Bagnall could not be given a fair trial, he said.

    Wallace continued the case to April because Booker will not be available for trial in March.
    The trial is now scheduled for April 17th.

    Murder trial delayed until June

    The new prosecutor in the murder trial of Michael D. Bagnall has been granted a request to delay the trial until June.

    Pennsylvania Deputy Attorney General Patrick J. Schulte entered his appearance March 31, taking over for Mercer County Assistant District Attorney Tyler Heckathorn due to a conflict, Schulte said.

    Bagnall is accused in the Feb. 28, 2015, slaying in Sharon of Jaylen “Bubby” West of Farrell, and stands charged with first-degree murder, aggravated assault and prohibited possession of a firearm.

    Schulte last Friday filed his motion to delay the trial, and he appeared in court Wednesday.

    “Just need a little bit more time to get ready,” Schulte said following the hearing. “We plan to be ready for trial in June.”

    A plea deal is on the table for the man accused of gunning down Jaylen “Bubby” West at a party on Feb. 28, 2015.

    And shooting suspect Michael Dwayne Bagnall, 33, of Farrell, has until the start of his trial Aug. 21 to decide if he wants to take it, said Pennsylvania Deputy Attorney General Patrick J. Schulte.

    His trial, which was to begin Tuesday, was continued again this week at the request of the defense, Schulte said. The murder trial, which was first scheduled for last June, has been continued four times.

    Defense attorney Stanley T. Booker asked for a continuance because he is going on vacation Aug. 6 to 13 and would not be prepared to begin trial Aug. 14. Mercer County Common Pleas Court Judge Daniel P. Wallace on Tuesday set a pretrial hearing for Aug. 14, with the trial to follow a week later, the second week of Mercer County's two-week trial term.

    “There is a killer in this room,” Deputy Attorney General Patrick J. Schulte said with dramatic flair Monday in his opening statement at a murder trial.

    “And that killer is Michael Bagnall,” Schulte said.

    Bagnall’s actions amounted to “justifiable homicide,” his attorney, Stanley T. Booker countered.

    “This wasn’t cold-blooded murder,” Booker said. “This was boiler plate self-defense.”

    Prosecutors rest case in Bagnall trial

    Prosecutors completed their testimony with Matthew Kelley, who served time in Mercer County Jail in the spring and summer of 2015 with Bagnall.

    They became friendly researching in the jail’s law library, Kelley said.

    Kelley said Bagnall told him: “There was a confrontation over money and he killed Bubby West,” Kelley said.

    Bagnall said self-defense “was the claim he was going for,” but that was not what happened, Kelley said.

    Bagnall said he believed he could get off, Kelley said.

    A jury Friday found Michael Bagnall guilty of first-degree murder in the 2015 shooting death of Jaylen "Bubby" West in Sharon.
    Sentencing was set for October 30th.

    Jaylan “Bubby’ West can finally rest, now that his murderer was sentenced to life in prison on Monday, Deputy Attorney General Patrick J. Schulte said.

    Mercer County Common Pleas Court Judge Daniel P. Wallace did not have much to say to Bagnall before imposing the sentence.

    “I’ve thought long and hard about this,” Wallace said.

    Then he sentenced Bagnall to “no less than life” in prison, consecutive to other sentences.
    Grieving mom got 'justice for my baby'

    “I had to wait two years, but finally I got justice for my baby,” said Joanna “Honey” West, Jaylan’s mother.

    “I hold no ill will against him,” Ula West, Jaylan’s grandmother said of Bagnall.

    Honey agreed. When asked how they could forgive Bagnall, the women replied, “We weren’t raised that way.”
    Honey and Ula celebrated their son and grandson.

    “I wanted you to see just how much Jaylan was loved,” Ula told the judge after inserting a photo of a church overflowing with friends, family and a large part of their community at his wake.

    Close to 7,000 people were at Jaylan’s calling hours, greatly surpassing the previous record set at the funeral home.
