The stepfather of the 13-year-old Essex girl found dead in a burning Essex rowhouse this week was accused yesterday of killing the girl and setting the house on fire before fleeing the scene.

Baltimore County police were searching yesterday for Carl Preston Evans Jr., 35, who was charged in a warrant with first-degree murder, attempted murder and first-degree arson. Police say the fire was apparently set to cover up the killing of Breaunna Floyd.

Evans is listed as a sexually violent offender on Maryland's Sex Offender Registry.

Evans was convicted of first-degree rape in a 1991 Baltimore case, authorities said. He was charged with raping a 21-year-old woman in West Baltimore at gunpoint and beating the woman. Four other suspects were arrested in the rape case, court records show.

Evans was charged last year with burglary, assault and kidnapping in Allegany County, according to court records. His defense lawyer in the case, Stephen R. Tully, said the charges stemmed from a confrontation between Evans and the husband of a woman Evans was allegedly having a relationship with at the time in Cumberland. The kidnapping charge related to Evans allegedly taking the woman out of her house, Tully said.

All of the charges were dropped by Allegany County prosecutors in May after a judge denied a request by the state's attorney's office for a continuance in the case, according to court documents and records.

Carl Preston Evans Jr., wanted in the killing of his 13-year-old stepdaughter in Essex last week, was captured yesterday by Baltimore County detectives after a brief foot chase through city streets.

Evans, 35, was taken to a local hospital for a "pre-existing injury," said Sgt. Vickie Warehime, county police spokeswoman.

After the killing July 25, authorities realized they did not know Evans' whereabouts, making him one of about 800 registered offenders in the state - one in five - for whom the state might not have an accurate address.

Also in the house at the time of the fire was the victim's 8-month-old half-sister, Mosett Kendrell Evans, who suffered injuries in the blaze.

Police believe that the fire was set in an attempt to conceal the killing of the teenager.

Police have declined to say how the girl was killed or disclose a motive for her killing.

State public safety officials are seeking help from lawmakers to help improve the registry's accuracy.

Officials want more offenders to check in with local law enforcement agencies to help track their movements.

Hummm, another rapist and abuser of women allowed to run free by our court system. Well Mr. Judge that wouldnt allow a continuance--we now have a 13 year old girl dead and a baby burned by this "wonderful" citizen in your community.

When are you (the judge) going to have the "b-lls" to stand up and say enough is enough and help convict these monsters instead of helping them get back on the streets? I sometimes get the impression that the judges "fight" the attorneys who are trying to get the guilty parties convicted. I am so tired of reading about these children murdered by these heartless violent bast--ds running the streets when they should have been in jail.

A Baltimore County jury convicted Evans in September of first-degree murder in the death of Breaunna Floyd, who was stabbed 24 times, strangled and beaten before being doused with gasoline and set on fire.
