Monroe County grand jurors indicted Yolanda Williams, 24, on charges of first-degree assault and endangering the welfare of a child in the death of A.J. Gibson Jr., who died July 21 after being immersed in hot water.
Homicide charges could be considered by another grand jury once prosecutors have received the final report establishing the cause of the boy's death, said Assistant District Attorney Douglas A. Randall.
A neighbor of Williams on Driving Park Avenue called 911 after Williams asked for help.
The boy wasn't breathing when police arrived at the scene.
The boy was covered with burns and he had a deep cut on his forehead, police said.
He was taken to Rochester General Hospital, where he was pronounced dead.
