    According to court documents, Saub gave investigators several different timelines and alibis for the day they believe Smith died. The paperwork said, on that same day, Saub wiped the data from his phone. Court documents also state tire marks left near the crime scene were consistent with those from a vehicle Saub drove, and mud on the wheels was similar to that from the scene where Smith’s body was found.

    According to the court documents, Saub voluntarily took a polygraph exam that revealed deception, and when asked if he shot Smith on purpose, Saub said, “No.”

    Sheriff Marshall said Saub has now been charged with Smith’s murder, use of a firearm in the commission of murder, and possession of a firearm by a convicted felon.

    Mary Jean Smith said her daughter first started communicating with Saub about two years ago when he was on the West Coast. Eventually, he came to the East Coast and ended up staying with Smith and Smith's grandmother in Hampton.

    Deputies said Saub was a tenant in the home.

    "All I can say is I warned her. I warned her. I did my best to persuade her to not have anything to do with this person. Just him being there around my family made me very uncomfortable," said Mary Jean Smith, who said there was something about Saub she never liked.

    Investigators said Smith and Saub recently traveled to Orlando, Florida and returned to the Hampton Roads area on April 15.

    Smith was last seen that morning in Courtland with Saub.>

    Eric Saub is accused of killing Jean Marie Smith. Court records show he's been the main suspect in her death. Search warrants for his phone, computer and Facebook account state that he has gone to great lengths to try to wipe everything from his phone. He reset his phone the day they believe Smith was killed. Saub also deleted all texts prior to Friday April 17, the day Smith's body was found in the county, the documents state.

    ISLE OF WIGHT COUNTY, Va. (WAVY) – A Hampton man will go to trial for the murder of a woman whose body was found in a wooded area of Isle of Wight County.
    It’s been nearly one year since investigators say a hunter found the body of 25-year-old Jean Marie Smith off of Courthouse Highway. Investigators believe Eric Saub of Hampton, who previously lived with Smith and thought of her as a sister to him, shot Smith in the head. After his arrest, he told WAVY News he did not kill her.
    “We just want to see justice served, and the victim’s family to have some closure,” said Commonwealth’s Attorney Georgette Phillips.
    In court Thursday, prosecutors argued that Saub and Smith’s cell phones were near the scene of where her body was found, around the time that she died. Saub’s DNA was found on Smith’s pant legs and shoes, Phillips said.
    Defense attorney Julian Bouchard said there was no physical evidence linking Saub to the crime.
    “The fact is there’s no direct evidence. There’s no motive…there’s no casing, there’s no gun, and that’s going to be problematic for the Commonwealth,” Bouchard said.

    Normally, a pretrial hearing will last roughly an hour. Saub’s self-represented hearing took around six hours. He offered 15 motions in the hearing.

    The hearing moved slowly through the motions Saub set forth. To prove his points, he called officers to the stand to testify. At times during the hearing, he was argumentative with witnesses. At one point, he called himself to the stand.

    The same judge also suggested, at least a dozen times, that Saub get a lawyer. To that suggestion Saub replied, “Noted.”

    After consideration of the arguments, the judge denied all of the evidence motions. He also denied a change of venue request and a request to recuse the Commonwealth’s Attorney.

    Eric Saub does have an advising attorney, Greg Matthews, appointed to the case. However, Matthews is only allowed to council Saub. The trial will begin on March 6.

    Eric Saub is accused of killing Jean Marie Smith back in 2015. Her body was found in a wooded area of Isle of Wight County.

    Saub will take his innocence plea to court this summer, where he will defend himself.

    “I feel the truth is on my side,” Saub said.

    Saub says he will prove his innocence on his own.

    “My [last] attorney tried to set trial without any investigations done at all,” he said. “I may not have experience in courtroom procedures, but I’ve read enough cases to know what the standard of proof is.”

    Wednesday, in Isle of Wight court, Eric Saub once again represented himself. He filed two motions, but one he claims will help prove his innocence in the murder case: a demand to hire an investigator.

    Saub gave several names and told the judge most of the people live in Florida. That is the state Saub and Smith traveled from when they passed through Isle of Wight County before her death. The judge granted that motion in favor of Saub to hire an investigator.

    As a result of today’s hearing, Saub trial has now been moved to April 2018.
