"Police believe no body left to recover in cold case murder"

According to the court document, on April 1, 2006, Spencer and East visited Smith's residence on Silver Mountain Drive, south of Camdenton, to check in on East's dog that was staying at Smith's. East told deputies that Spencer and Smith were talking behind the house as Smith was practicing with a firearm. East left the two men talking to visit his dog in the car, when after about five minutes, East reported hearing a gun shot and observed the two men wrestling for control of the firearm.

A Camdenton area man accused of a cold case murder dating back to 2006 could learn his fate today in a Camden County courtroom. A jury trial was scheduled to begin in the first-degree murder case of David W. Smith. Smith is accused of killing Shawn Eric Spencer in an, apparent, dispute over drugs despite, reportedly, no evidence being found from the alleged crime, including Spencer’s body. However, the attorney for Smith requested that the trial be stricken in favor of a plea hearing which is, instead, scheduled to be taken up this morning.

'He was loved' family remembers Shawn Spencer; Smith sentenced

    http://www.lakenewsonline.com/news/2...ed-to-19-years

On Nov. 28, nearly two dozen of Spencer’s family and friends gathered at the Camden County Courthouse in matching black t-shirts that read “In Loving Memory of Shawn Spencer” with buttons featuring pictures of Spencer from various stages of his life. They came to hear the outcome of the case that has shaken the family to its core.

“He was loved. He was just a good person,” said sister Shelly Vicino, who came from Arizona to attend the hearing. “He was loyal almost to a fault. He would have done anything for his friends and family.”

Vicino described her brother as a free spirit with a big heart who got into typical teenager trouble.

“He was not a transient. He had a loving family. My mom searched the streets for him for over ten years,” Vicino said. “I just feel like a part of me is gone.”

Spencer loved his dogs more than himself, family members said.

“He would sometimes go without eating to make sure his dogs were fed,” Vicino said. “He would go to McDonalds and get a burger and let the dogs have the patty and he would just eat the bun.”
The family said that although they were happy to see Smith sentenced to prison, they were not happy with the plea bargain and length of sentence.

“It’s just nothing,” Spencer’s aunt Linda Patience said. “They spent three quarters of that sentence looking for him, while he was free living his life.”
