    Felony Murder does not require specific intent to kill, just intent to commit a Felony.

    Preate likened it to an officer who dies in a car crash during a vehicle pursuit, or a bystander who gets shot by law enforcement during a firefight — in both cases, the suspects also could face murder charges.

    Charges filed Thursday against three teens for the 29-year-old patrolman’s death haven’t brought any closure, but they have taken officers one step closer to healing.

    Three 17-year-olds — Nasiir Jones and Tanner Curtis, of Scranton, and Isiah Edwards, listed as homeless — are each charged with second-degree murder, murder of a law enforcement officer in the second degree, robbery and various other crimes. State police said Jones pointed a shotgun at a man in West Scranton on July 11 during a robbery, then fled in an SUV with Edwards and Curtis. Police chased the SUV until it crashed and arrested all three after a brief foot pursuit on Lafayette Street near North Main Avenue.

    Lackawanna County Judge Margaret Bisignani Moyle rejected defense petitions Tuesday to transfer Nasiir Jones, Tanner Curtis and Isiah Edwards back to juvenile court, citing evidence that the defendants likely cannot be rehabilitated by the age 21 cutoff date for supervision under the juvenile system.

    The three teens accused of criminal homicide in the death of a Scranton police officer are scheduled to start trial Feb. 27.

    Judge Margaret Bisignani Moyle was clear to set the date Wednesday after denying appeals from the teens’ attorneys on her decision to keep their cases in adult court.
    The teens each are charged with second-degree homicide, murder of a law enforcement officer, involuntary manslaughter and armed robbery, among other crimes.

    Because it is an emotionally charged, high-profile case in the community, attorneys for all three teens said they plan to petition the court for a change of venue for the trial, or at least an out-of-town judge and jury. Defense attorneys also said they will ask the court to try the three teens separately, among several other pretrial motions. The district attorney’s office wants to try the teens together in one case.

    The trial for three Scranton teens accused of homicide in the 2015 death of a city police officer is delayed by more than five months.

    Judge Margaret Bisignani Moyle delayed the start of the Feb. 27 trial to Aug. 7, after all parties agreed, said Bernie Brown, one of the attorneys for Mr. Curtis.

    Judge Moyle still must rule on several motions from the defendants’ five attorneys, including whether to split the criminal case into three separate cases and to change the trial venue or bring in an out-of-county jury. She set a hearing for June 26 to decide those and other defense motions.

    Attorneys for Nasir Jones, Tanner Curtis and Isaiah Edwards believe comments former Assistant D.A. Gene Talerico made could influence a jury poll.

    They say his comments encouraged people to support Officer John Wilding following his death.

    Even if the judge chooses to keep the trial in Lackawanna County, she fears billboards for public commemorations for Wilding and other fallen officers, that happen to coincide with the trial, could influence a jury from outside the area.

    Jury selection is set to begin July 28th, however the judge now says these series of pre-trial motions could force it to be delayed.

    Two years after the death of a Scranton police officer, the “charged atmosphere” it created has not dissipated and the three teens charged in his death cannot get a fair trial here, an attorney for one of the defendants argued Tuesday.

    It’s a move Lackawanna County Judge Margaret Bisignani Moyle seemed reluctant to consider, though she acknowledged she must decide soon.

    No decision came Tuesday on changing the jury or moving the trial. Also still outstanding is a decision on splitting the case into separate trials. A status conference is scheduled for the end of July.

    Lackawanna County Senior Judge Carmen D. Minora will mediate the case of three teens charged with Scranton Patrolman John Wilding’s death under a rare move by the court to try to foster negotiated pleas with the defendants.

    President Judge Michael J. Barrasse’s appointment of Minora to serve as third-party mediator comes as Judge Margaret Bisignani Moyle continues to weigh a series of motions filed by Tanner Curtis, Isiah Edwards and Nasiir Jones in advance of their trial on second-degree murder and other charges in Wilding’s death.

    The trial, which was to begin last week with jury selection, is likely off until at least autumn.

    Three teenagers who were charged in connection with the death of a Scranton police officer two years ago pleaded guilty and were immediately sentenced Thursday in Lackawanna County.

    Each one of the suspects pleaded guilty to third-degree murder and robbery.

    Each suspect was immediately sentenced to nine to 18 years in state prison.

    "Nothing, no sentence that the courts or anyone can impose can have ultimate justice or bring John back," Scranton police chief Carl Graziano said after the sentencing.

    She and others from slain Scranton police Patrolman John Wilding’s family laid bare their grief Thursday in Lackawanna County Court, the end of a whirlwind day which abruptly brought plea deals, a sentencing and the end to a two-year saga.

    “You need to hear the hurt you caused,” Police Chief Carl Graziano told the three defendants before they were sentenced. “I don’t know you know that ... I pray you do.”
