At 15 years old, Derrys Sanders Jr. still could spend the rest of his life in prison for pleading guilty Friday to first-degree murder in the July 2015 shooting death of 18-year-old Jacob Pushinsky.

But his plea deal still gives Sanders -- charged when he was 14 and one of the youngest homicide defendants in Erie County history -- the chance to get out of prison early.

As part of the plea deal, Connelly at sentencing will allow for the possibility that Sanders could be paroled after he serves his minimum sentence, whenever that might be. The district attorney's office intends to ask for more than mandatory minimum but agreed to make parole an option.

The plea deal "does spare" Sanders "a sentence of life without parole," Connelly told Sanders.

Jacob Pushinsky's parents clutched each other and wept Friday as they told a judge about the life their son could have had.

"We can't see him, we can't see hear his voice, we can't see him graduate; no grandbabies," Lisa Pushinsky said. "To me that's a life sentence."

Jacob Pushinsky's shooter, 15-year-old Derrys Sanders Jr., on Friday received a sentence of 35 years to life in prison. The mandatory maximum sentence of life means Sanders will remain on parole for the rest of his life if he is released from prison. Sanders will be eligible for parole after he serves 35 years.

Sanders apologized in court.

"I truly and sincerely apologize to the community, my family and the Pushinsky family," he said.
 
March 2018:

14-year-old who killed teen for his bicycle denied break on his 35-year-to-life prison term
Derrys Sanders Jr. was 14 years old when he killed another teen because he wanted the victim's bicycle.

A state Superior Court panel has decided that Sanders can keep serving the 35-year-to-life prison sentence he received for that "cold and calculating" crime.

The state court made that call in an opinion by President Judge Emeritus John Bender denying an appeal by Sanders, who claimed he is being punished too severely.
