    Death penalty still in play for Mark Sievers

    FORT MYERS, Fla. — A motion by Mark Sievers’ attorneys to dismiss the death penalty has been denied, according to court documents.

    Sievers’ attorneys argued the state’s notice of intent to seek the death penalty, filed in June, wasn’t filed soon enough.

    Sievers is charged with first-degree murder for the 2015 killing of his wife, Dr. Teresa Sievers, at their home in Bonita Springs.

    The state is also seeking the death penalty against Jimmy Rodgers, one of two alleged co-conspirators. Investigators believe Mark Sievers, who pleaded not guilty, planned the killing and promised Wayne Wright, his childhood friend, payment for carrying out the plan.

    Wright in turn recruited Rodgers, who traveled from Missouri to assist in the killing, prosecutors allege. Wright accepted a plea deal and is expected to testify against Rodgers and Mark.

    EE COUNTY, Fla. -
    The daughters of murdered Dr. Teresa Sievers may be moving to Connecticut with their maternal grandmother.

    Mary Ann Groves motioned for the move in dependency court where she was granted guardianship in 2016 while their father Mark is in jail, accused of murdering his wife.

    The Department of Children and Families supported the grandmother's effort to move the children to her hometown of Seymour, Connecticut.

    In a hearing Tuesday afternoon in front of Judge Robert J. Branning, Groves took the stand to argue for her motion.

    She told the court the girls are spending the summer in Connecticut with their cousins, aunts, uncles, and numerous family members.

    Groves discussed personal concerns over her aging husband, who still lives in Connecticut and traveled to Lee County to visit on multiple occasions on his own.

    Groves argued attention to the case and awareness in the community about the murder of Teresa and arrest of Mark can be hard on the girls, who are enrolled in a Lee County charter school.

    Branning asked Groves several questions himself, about her plans to continue the relationship the girls have with their paternal family, as well as Groves prior commitments to remaining in Lee County "for the long haul" in her hearing pleading for guardianship. Groves told the judge things changed, leading to the most recent petition.

    The hearing was continued after Grove's attorney Christina O'Brien rested her case for the motion, giving the defense their chance to argue their side. The next court hearing will come within the next thirty days.

    "One person who never strayed far from Mark's inbox was Wright.

    In 2014, Wright texted Sievers, wondering why he had called. Sievers texted back, "nothing honey, just checking to see what's up with you."

    In another text, Sievers asks Wright, "how's everything going, baby?"
