Royce Atkins insisted to a Northampton County jury that he never saw the 9-year-old boy he hit and killed last year before driving off. But the panel needed just 50 minutes to say it didn't believe him.

In a quick verdict Thursday, Atkins was found guilty of hit-and-run in the accident on Schoenersville Road in which Darious Condash was fatally injured as he reached to pick up a piece of candy he had dropped.

The decision brought tears of relief from the family of Darious and the promise of prison for Atkins, a 23-year-old mechanic who faces a mandatory minimum sentence of three years behind bars.

"Now Darious can sleep in peace," the boy's cousin, Yacinda Gonzalez, said outside the courthouse in Easton. Atkins "deep down, regardless of what he said, he knows what he did was wrong."

Royce will be sentenced on January 20th.

An ingrown toenail won't get Royce Atkins out of jail as he awaits sentencing for fleeing a car accident in which he killed a 9-year-old boy as he crossed the street in Northampton County.

On Friday, Judge Michael Koury Jr. denied a bid by Atkins' lawyer to have the 23-year-old Hanover Township man released two weeks before sentencing, a decision reached as family members of the late Darious Condash packed the courtroom.

"People are in jail for extended periods of time, and during that time, their medical needs are addressed with prison doctors," Koury said.

Atkins is scheduled to be sentenced March 3. If he doesn't get the treatment before then, Koury said, he'll have to get it at state prison.

"The state prisons obviously have very competent medical staff for Mr. Atkins as well," Koury said.

Royce Atkins apologized Friday for failing to stop and help 9-year-old Darious Condash after he drove into and killed the child.

But the 23-year-old Hanover Township man's apology rang hollow in light of callous and expletive-filled comments he made to his father and girlfriend in phone calls recorded at Northampton County Prison.

"I really hope the judge here realizes this s--t is being blown out of proportion," Atkins said in a phone call on Jan. 6. "That family, they are reacting like they're the victims. What about my family? My family is the victims too."

Northampton County Judge Michael Koury sentenced Atkins to four to 10 years in state prison, a year above the three-year mandatory minimum sentence but a year below the statutory maximum of five to 10 years.

Atkins earned the sentence because he's a "heartless human being who lacks a social conscience," Koury said.

Condash's mother said she'll never forgive Atkins.

"I'm very angry over the loss of my son and there are no words that you can say that will make me change or make me feel any better," said Siomara Merced to Atkins.

She asked for the maximum sentence allowed by law, adding "any time he serves would not measure up to the talented, amazing life of Darious Condash."

Koury said what you say in private is more indicative of your true feelings than a public apology.

"I believe the statements he made regarding the court evidence a total lack of respect for the court system and the jury's verdict," Koury said.

Condash's mother said Atkins' final judgment is yet to come.

"Today is not just your ultimate judgment day," Merced told Atkins. "Your final day is coming one day. And I hope everything you said in this court was the right thing because you will have to answer to that one person above."

Convicted of fleeing the scene of an accident in which he killed a 9-year-old boy, a Northampton County driver says his 4-10-year sentence is too harsh.

In a legal filing, Royce Atkins asked Northampton County Judge Michael Koury Jr. to reconsider, claiming the prison term he received this month is both "extremely lengthy" and "manifestly unreasonable."

Atkins, 23, of Hanover Township, was guaranteed a sentence of at least three years in prison when he was before Koury on March 3. But Koury tacked another year onto that mandatory minimum, highlighting recorded phone calls from jail in which Atkins used four-letter words in describing both Darious' family and the judge.

In handing down the lengthier term, Koury called Atkins callous, cruel and "a heartless human being who lacks social conscience."

On Monday, in post-sentence motions, defense attorney Philip Lauer argued that Koury was improperly swayed by the recordings, which Lauer says merely showed his client in private moments of anger and frustration.

A Northampton County judge is sticking by the enhanced sentence he gave a driver who hit and killed a 9-year-old boy who was crossing the street in Hanover Township.

In March, Royce Atkins was ordered to serve four to 10 years in state prison by Judge Michael Koury Jr. after being convicted of fleeing the scene of an accident. But Atkins asked Koury to reconsider, arguing the punishment was too harsh and that the judge was biased against him.

Koury rejected those arguments in a ruling Monday, setting the stage for an appeal to Superior Court.
