    NY - Teacher denies sex with child

    A former Catholic school teacher took the stand in a Queens courtroom yesterday to deny an affair with a student and said he wept in despair when he heard the allegations.
    "I started to cry," Francis Catapano testified at his trial on misdemeanor sexual assault charges.

    "My wife told me to suck it up and be a man about it. I didn't know what to do - it was just overwhelming. I didn't know how to react."

    Catapano, 62, is charged with starting an affair with a 15-year-old girl while tutoring her alone in his eighth-grade classroom.

    Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?

    A Queens jury took about three hours to find a former Catholic schoolteacher not guilty of having an affair with a student.
    Frank Catapano, 62, nearly collapsed, grabbing the defense table with both hands as the jury forewoman read "not guilty" on eight counts of sex abuse and endangering the welfare of a child.

    "It's not going to really help," said Catapano, who had been facing a year in jail.
