Police: Dearborn officer fatally shoots unarmed man


A unarmed man wanted on a probation violation warrant and suspected in a larceny was fatally shot by a Dearborn police officer following a struggle Wednesday afternoon on Detroit's west side, police said.

Family members identified the man as 35-year-old Kevin Matthews, who they said was on medication for schizophrenia.

"They shot my son for nothing," said his mother, Valerie Johnson, wiping away tears. "He didn't have no weapon."

Dearborn police chief dedicated to transparency in fatal shooting investigation

According to the article Detroit police are conducting the homicide investigation, but Dearborn police will cooperate with them. That's what the transparency refers to.

Dearborn police said the officer spotted Matthews, "who was known to be wanted on a probation violation warrant, and who escaped from officers earlier in the day after committing a larceny in Dearborn," walking in the area of Tireman and Greenfield in Dearborn about 12:30 p.m. Dec. 23.

"The officer approached the subject ... and the subject fled on foot," Dearborn police said. "The officer chased the subject and encountered him several houses away, in Detroit, where a struggle ensued.

"Subsequently, the officer fired his department issued weapon; striking the subject. The subject was pronounced dead at the scene ... "

"Kevin Matthews was known in that area," Williams said at a news conference last week. "He went back and forth to the gas station all the time, known to be one of those who you would see and you would say 'Hey, Kev' as you walked down the street.

"It was also known ... that Kevin Matthews suffered from mental illness, suffered from paranoid schizophrenia ... which is a disability that officers and community members have to be very careful with when they're dealing with somebody like that."
 
Looks like a justified shooting, in my opinion. He was a fleeing felon, running from an arrest warrant, fighting with an officer in a field, trying to get away. The officer had every right to defend himself, imo

“They went in front of the garage (and out of view), and then I heard the man say, ‘Stop it! Stop it!’ Those were his last words; right after that, I heard five gunshots. Then I heard a police radio, and then a bunch of sirens.”

People are expecting that an officer goes with an arrest warrant for a mentally ill felon, to try and take him back to jail, and if the felon runs, and is caught in a backyard, and begins fighting the officer, the officer is not supposed to shoot him to end the physical fighting? Is he supposed to just let the guy go or let the guy keep beating on him?

Who is going to want to take the job of trying to apprehend felons if they are not allowed to defend themselves in a street fight?

I'm pro-officer for the most part, but I don't think a physical fight automatically gives the officer the right to draw his gun and shoot somebody. There has to be more than just a physical fight. I can't see justification of shooting a guy to death over a physical fight. I can't.

That being said if the Phyiscal fight gives the officers no outs, and that physical fight will possibly end in the officer's life, than yes shoot.

No, since you asked, I expect that the officer will shoot him. At least many LEOs on the job nowadays would.

Fleeing felons, and running from the officer don't give justification to shoot. Fighting with an officer very well might if it's life or death for the officer, but it's a case by case basis, and I haven't heard enough about this case. imo

If someone breaks into your house and begins to attack you, then you have the right to shoot them.

It is very similar for a police officer, serving an arrest warrant on a felon. If they begin to fight the officer, and are injuring him, he does not have to allow that to happen, in his LEGAL PURSUIT of a felon. He has the right, as the arresting officer, to use lethal force to protect himself. He is not legally required to get beat up, punched, kicked or any of that.

Runnimng does not give justification to shoot unless the fleeing felon is deemed dangerous to the public safety.

But this guy had stopped fleeing and was FIGHTING. A cop with an arrest warrant does not need to subject himself to a beating. He is legally allowed to use force if the suspect is injuring him.

He did wait 3 minutes before shooting. That's a longer time than some we have seen and read about. So there is that.

Difficult to judge or have an honest intelligent discussion without facts and knowledge.

The case law is in the above SCOTUS case. It clearly sets parameters for a fleeing suspect and when the pursuing officer may use and may not use lethal force.

All LEOs know this and are trained in this and I've never run into anyone in the public that wasn't at aware of this "fleeing felon law" as it has been erroneously deemed, until joining WS.

It defines what is constitutional and legal and unconstitutional and illegal when in the process of arresting a fleeing suspect.

When the officer arrived at a nearby hospital for treatment of minor injuries sustained in the skirmish, a police source said he wasn’t aware the suspect had died, and that he asked whether he was OK.

Another 'he went for my gun' defense. Sorry, but stopped believing this a long time ago - one can only sell me the same story two maybe three times. What is new imo is, the loose gun belt. If I hear a loose gun belt in another story though - will not believe this one.

In order for me to start believing the 'went for my gun defense' I would now have to be sold on 'all the black guys in America got together and agreed that if they were ever tackled by LE - go for their gun'.

Also, 5 gunshots will pretty much ensure death. Not finding the statement that the officer didn't know this man had died credible.

All jmo.

Family members said Matthews was recovering from a broken arm sustained when he was hit by a car Thanksgiving Day. He reportedly suffered from paranoid schizophrenia and was prescribed medication.

The repeated 'stop it' bothers me. Not something someone would say if they were busy reaching for a gun. Sounds like a submissive response to a gun being pointed at them instead.

Never mind the fact that once again the shot victim was A PERP, that had committed a CRIME, was FLEEING, an officer, RESISTED ARREST, was FIGHTING BACK, and could have injured or killed the officer or bystanders had he gotten hold of the gun. So right here I have a problem with anyone portraying this person as innocent or harmless. If we are going to move forward and come to a middle ground between law enforcement and the black community we need to also get to the root of the criminal as well and stop portraying all of those killed as gentle, innocent, harmless etc. This is only my point of view of course. Everyone is losing here. Officers and communities alike.

Possibly you are judging American cops based on Ontario Cops. Lived and interfaced with American cops?

In my experience, if the officer doesn't control the situation totally and quickly either one or two things begin to happen. 1) the gun begins to come free from the holster. 2) the suspect will physically touch, hold or attempt to get gun.

I have had my belt almost pulled up to my armpits due to a suspect pulling on my gun coupled with the ground struggle.

From your post the prejudice is clear, however I don't understand the irrationality WRT this case specifically when there is no evidence.
