Wow, that's shocking. I wonder if the officer realized she was standing right behind her father.
 
Evictions are always bad business, IMO. I hate to see anyone evicted during the winter and especially if there are children involved. It breaks my heart to see an innocent 12 year old killed when the Dad should have protected her.

The Dad knew the eviction was coming and I blame him for not having done something about it.

DUNCANNON, Pa. (WHTM) – Police say a 12-year-old girl is the victim of a fatal shooting during an apartment eviction attempt Monday morning.

The girl was standing directly behind her father, 57-year-old Donald B. Meyer, when a constable shot Mr. Meyer in the arm, state police in Newport said Tuesday.

The bullet passed through Donald Meyer’s left upper arm and struck his daughter, identified by family members as Ciara Meyer. She was pronounced dead at the scene. An autopsy is scheduled Wednesday.

Pennsylvania State Constable Clarke Steele was at*the Pfautz Apartments on Rebecca Drive in Penn Township*with an eviction order for Meyer and his family.*Police said Meyer opened the door and shut it. He then reopened the door and exchanged words with the constable before leveling a loaded .223 caliber rifle that had been slung and concealed along his body,* police said.

With the rifle pointed directly at his chest, police said Steele, who was in uniform, unholstered his .40 caliber duty handgun and fired one shot.

Police said employees of the apartment complex were on scene for the eviction and witnessed the incident.

Donald Meyer was flown to Penn State Hershey Medical Center. Police said his gun had a round in the chamber and a magazine with 30 rounds. He has been charged with aggravated assault, simple assault, terroristic threats, and reckless endangerment.

Meyer was arraigned Tuesday before District Judge Daniel McGuire by video. He was expected to be released from the hospital later in the day or Wednesday. Court papers show he’ll be held in Perry County Prison without bail. A preliminary hearing is scheduled Jan. 15.

But. They knew that he wasn't home alone. Plus they should have seen her standing behind him.

Now if they had nowhere to go. Than of course tensions would be very high. But professionals should know how to hold off until the coast is clear.

It's not like the apartment would be rented out the next day. So if someone is combative over an eviction with kids in the home. Then you simply should wait before trying to force them out at that very second.

This is why swat have negotiators. Jmo. The constable should have known who was in the house and that the tension was very high and simply backed off and came back later for a sneak attack at the mailbox or something.

Depending how big dad was, it's possible that she wasn't seen. Plus come on, showing a gun to LE?! Really? You thought LE was going to just back up and say "we'll come back"?
If there's a blame or partial responsibility it's on the dad. Intimidating anyone, specially LE, with a fire arm is a big no no.
So tragic all around 😢

Yes, very tragic for everyone involved. I hate it when people say that LE should have known who all was in the home. I hate it when people second guess what the function of LE is.

In the first article the time was listed @ being 10:05am when the altercation occurred. Shouldn't the 12 year old female have been at school?

IMO, the Dad escalated the situation by brandishing a gun. It was an eviction he was well aware of beforehand. He had to know LE would have reacted.

Many people who disparage LE will be the first to call on them if they need them.

It's terribly sad about the little girl, but you can't fault LE. If he had a gun pointed at his chest what does he expect, it's shoot or be shot. It's stupidity to escalate the situation to that point.
 
If dad wanted to shoot the officer. Wouldnt he have done it before the officer drew his weapon?

The gun was pointed at his chest and he probably said leave now. But the officer still had time to pull out his gun instead of just leaving.

Btw. The militia is pointing guns at LE from towers and federal property. But no shots fired during that eviction process. Hmm. They are simply trying to negotiate with armed men that are occupying a federal property. Jmo

The Latest: Family Doesn't Blame Constable in Girl's Death

Rohde says two different county child protection agencies had been involved with the family and that at one point the girl had been removed from their home for several months.

One of the girl's aunts, Stephanie Cordas, says the family believes the father's actions were wrong.
 
I think any eviction is sad, and this shooting was tragic, period. But I've not seen enough concrete info to determine whether LE was justified in using force per local LE policy & state laws. IDK, but am trying to understand rationale of post I'm parsing, w my thoughts, JM2cts, in red below.

Is anyone saying the man was surprised when LEO knocked on door, that he did not know the judge ordered him to vacate 30+ days prior? If LE waited until "coast was clear" meaning apt = empty, LE might never have the opportunity.]

If tenant wants to appeal judicial procedure, he is free to do so, but pointing gun or other weapon at LEO at door is not the lawful method. If you are standing at a doorway and somebody opens the door and raises a shotgun at your chest, you are very close and have very little time to respond.

I bet he never even knew the child was behind her father.
