Tim Bosma murder trial hears he was shot in truck, then burned

HAMILTON – The accused killers of a Hamilton man who disappeared after leaving home with two strangers for a test drive of his pickup truck first shot their victim and then burned his remains, their trial heard Monday.

Dellen Millard, of Toronto, and Mark Smich, from Oakville, Ont., have both pleaded not guilty to first-degree murder in the death of Tim Bosma.

Tim Bosma was abducted and shot at close range inside his truck, and his body was incinerated hours later, the Crown told the trial of two men accused in the Ancaster, Ont., man's death.

After an opening address by assistant Crown attorney Craig Fraser, the trial of Dellen Millard and Mark Smich, the two men accused of killing Bosma, continued Monday afternoon with Bosma's wife, Sharlene, on the stand as the first witness.

Tim Bosma wondered if he should join accused for test drive of his truck, murder trial hears

HAMILTON—Tim Bosma was pacing in front of the TV the evening of May 6, 2013, waiting for two men to come down from Toronto to see a pick-up truck he had been trying to sell for weeks.

“Who comes this late to see a truck?” the 32-year-old Ancaster father said to his wife, Sharlene.
It will never be known if Bosma was having second thoughts or felt something was amiss that night.

Accused killers burned Tim Bosma ‘beyond recognition,’ Crown says at first day of trial

A forensic anthropologist from the University of Toronto and police investigators recovered 58 bone fragments, two virtually complete bones and one tooth from The Eliminator.


The expert opinion will show that 17 fragments, one bone and the tooth definitely appeared to be human, likely an adult male, Fraser said.


Also, Bosma’s blood was found on the incinerator.

Court hears Tim Bosma was shot in truck, then burned

Fraser said police found the pickup truck at the home of Millard’s mother in Kleinburg, Ont., with the seats ripped out.


Police found gunshot residue as well as Bosma’s blood both inside and outside the vehicle, Fraser said, adding that police later found some of Bosma’s bones inside the incinerator. Fraser said Millard’s fingerprints were found throughout Bosma’s truck along with a shell casing from a bullet.


He also said police found the keys to Bosma’s truck in Millard’s car when he was arrested.

Instead, she focuses on Tim.

They met on E-Harmony in November 2008, she tells the court after assistant Crown Tony Leitch asks about the beginning of the Bosma love affair.

"After a week or two of chatting, we eventually met and had a very disastrous first date," she says, laughing. By the third date they were hooked.

HAMILTON —The trial of two accused killers of a Hamilton man who took them for a test drive in his pickup truck heard Tuesday from a fingerprint analyst who matched a print from the truck to one of those on trial.
Robert Felske, a forensic identification officer with Halton Regional Police, said a fingerprint from the rearview mirror of Tim Bosma’s truck matched the right thumb of Dellen Millard.

Also a shorter sketchy guy with a red hoodie who never spoke.

Then there is a print from a right thumb with a double loop whorl.

Together, these bits of evidence begin to answer the question of who test drove Tim Bosma's truck.

Jurors at the first-degree murder trial of accused killers Dellen Millard, 30, and Mark Smich, 28, were presented with very different kinds of evidence Tuesday by the Crown team around the issue of that fatal test drive. There was the testimony of an eye witness describing the two men who walked up the Bosmas' long country lane just after 9 p.m. on May 6, 2013. And the expert testimony of a veteran forensics officer who specializes in fingerprints.

The intricacies of using cellphone records in a criminal investigation were on display in Superior Court in Hamilton Wednesday, at the trial of two men charged with first-degree murder in connection with the death Tim Bosma, of Ancaster, Ont.

At 5:13 p.m. on May 6, Bosma's phone called the Bate phone.
At 7:22 p.m., the Bate phone contacted Bosma's phone.
At 9:04 p.m., the Bate phone called Bosma's phone.

HAMILTON—One of the lead investigators into the death of a man slain after going on a test drive with two strangers told jurors on Wednesday that it was a tip about one of the accused killer’s tattoos that gave police a major breakthrough in the case.
Det. Greg Jackson said a Toronto man, Igor Tumemenko, scheduled to testify later in the trial, told police about a test drive linked to the same phone number involved in Tim Bosma’s disappearance. Bosma’s body was found a week later burned beyond recognition.

After hearing from Tumemenko, police focused their investigation on the tattoo and the cell phone, Jackson said.
“In the course of the investigation, you received information from two reliable police sources in Peel and Toronto about Mr. Millard having an ambition tattoo, correct?” asked Crown attorney Anthony Leitch.
“That’s correct,” Jackson said.
Jackson said they tried but were unable to get finger and footprints from Tumemenko’s truck.

Witness became suspicious when Dodge pickup appeared at Millard Air hangar a day after accused texted employees to stay
home.

HAMILTON—An employee of an aviation company owned by one of Tim Bosma’s accused killers testified Thursday that he recognized the dead man’s car parked inside an airport hangar and eventually notified police.

Arthur Jennings said he was shocked when he saw the pickup truck that was “identical” to one police and media reports had said belonged to Bosma, who disappeared on May 6, 2013, after going on a test drive with two men.

Bosma murder trial: ‘Nobody comes to the hangar today’

Arthur Jennings was a co-op student at Millardair when he got a text from Dellen Millard on May 7, 2013.

Jennings's son-in-law — who was a full-time employee at the hangar, essentially as Millard's second-in-command — got the text, too. It told them not to come to work:

"Airport politics. Nobody comes to the hangar today. Not even to pick something up."

Millard wanted black truck painted red: witness

HAMILTON — One of the men accused of killing Tim Bosma placed an urgent order to have a black pickup truck painted red just days after the Hamilton man went missing, court heard Monday.

The owner of an autobody shop testified that Dellen Millard called him on May 8, 2013, wanting a rush job on the work and offering to drop off the truck the next day.

When asked if he wanted the interior repainted as well, Millard said he had already stripped it down and to leave it black, Tony Diciano told the court.

But before the work could be done, Millard left a message with the shop's manager to cancel the order, Diciano said.

A longtime customer, Millard had never before requested that kind of work or with such a quick turnaround, the shop owner said.
