Tommy Page, 29, of North Haverhill is charged with alternate counts of first and second-degree murder, and manslaughter in connection with the Nov. 13, 2015 death of Shawn Sylvester.

The indictments allege that Page knowingly caused the year-old boy’s death by applying crushing force to his head before, after or while sexually assaulting the infant... The manslaughter count charges that Page manifested exceptional cruelty or depravity before his death. He also provided the child with Subxone, a controlled drug, and did not immediately seek medical attention following the injuries that led to his death...

Page, who had been living in the Fowler River Road Alexandria home with the child’s mother, was arrested and charged with 23 counts of possession of child sexual abuse images, after investigators found images on his cell phone of an infant male child engaging in sexually explicit conduct.

I think she at least deserves a negligence charge of some sort. Poor little baby.

Lawyers for man accused in child's death seek to exclude photos from trial

Prosecutors said they seized 23 sexually graphic photographs from Page's cellphone. A forensic expert testified Tuesday that he was asked to examine Page's phone and found the images.

"The thumbnails that I saw were of a young child that was in sexually graphic positions and being sexually abused," forensic expert Matthew Pickering said.

Defense lawyers are trying to keep the pictures out of evidence at Page's upcoming trial, saying that they were illegally obtained and arguing that the pictures were outside the scope of the search warrant.

The judge took the matter under advisement. The trial is scheduled for September.

A judge has ruled that the 23 photos of a child's naked and battered body found on a defendant's cellphone can be used as evidence in his murder trial, according to the New Hampshire Union Leader.

Tommy Page is accused of sexually assaulting and killing 11-month-old Shawn Sylvester and is set to go on trial Sept. 11.

Prosecutors said Page took 14 pictures of what he had done to Shawn, and those pictures were found on his cellphone.

"Shawn was brutalized during a two-hour period when he was alone with the defendant and no one else," Assistant Attorney General Geoffrey Ward said.

Defense attorney Jay Duguay said Page didn't kill Shawn, placing the blame on the boy's mother, Danielle Sylvester. Duguay said Sylvester was upset when she returned home from her doctor's appointment because she wasn't able to pick up her prescription drugs at the pharmacy.

The state’s deputy medical examiner told a jury on Monday that the multiple blunt-impact injuries that resulted in the death of an 11-month-old boy in 2015 occurred up to three hours before an ambulance was called.

Dr. Jennie Duval, a board-certified forensic pathologist, described graphic photographs of the injuries for the jury that she had taken during the autopsy.

“They can’t be explained away as a fall,” Duval said.

Judge Lawrence MacLeod dismissed the jury for the day about 1:45 p.m. Monday. They were told to return to the courthouse at 9 a.m. today for closing arguments.

Tommy Page was found guilty of first-degree murder and falsifying evidence in connection with the death of 11-month-old Shawn Sylvester. He was found not guilty of administering a controlled substance.

Even with a guilty verdict, prosecutors said there's nothing they can do to fix the pain felt by Shawn's family and that they are "as any family would, still devastated, still traumatized, still pained," Hinckley said.

Page will remain behind bars until he is sentenced in a couple weeks, but a date has not been set.
 
OMG.This is one of the most horrific things I have ever read.That poor baby tortured and the monster took pictures of it.And I find it hard to believe that Shawn was just abused that one day.His mom had to have noticed something before.
 
So sick and I hope prison will be his worse nightmare.

A former Alexandria man was sentenced Wednesday to life imprisonment without the possibility of parole for abusing and killing his girlfriend’s 11-month-old son in 2015.

“I found the evidence credible and find it hard to fathom, frankly, the depravity you perpetrated on this young victim,” Judge Lawrence MacLeod told Tommy Page, 30, before handing down the maximum sentence.

In her own remarks to the court, Danielle Sylvester said she will never forget nurses at Dartmouth-Hitchcock Medical Center telling her and her husband that her baby’s brain injuries were irreparable and that they needed to let him go.

“I think of him every day. What he would be doing, how he would be as a brother, son or grandson. None of that is going to happen.”
 
I was sicked when I first read about baby Shawn, literally threw up everywhere. I am so glad he was found guilty and got life without parole.
