Police in the US are continuing their investigation into the death of a Limerick man who was killed in a suspected domestic disturbance at his home in North Carolina.

Jason Corbett (39), who is originally from the Janesboro area of Limerick city, was found at Panther Creek Court in Wallburg with fatal head injuries early on Sunday morning. The father of two children, moved to America four years ago after his first wife Mags Corbett died following an asthma attack in 2006. Its understood Mr Corbett was living in North Carolina with his new partner who is American and who previously worked as a child minder.

Thomas Martens, a former FBI agent, told 911 he had been “in an argument” with his son-in-law and that he had “struck him with a baseball bat”, the Irish Daily Mail reports. According to an police incident report seen by the paper, the incident was recorded as “an assault” by 911.

His wife Molly was believed to have been the main suspect but police in the US have confirmed that her father Thomas Martens (65), a retired FBI agent, is also a person of interest.

LEXINGTON, N.C. -- Attorneys for Thomas Martens and Molly Corbett, charged with murdering Molly's husband Jason Corbett in their Wallburg home in Aug. 2015, said they may request to move the case elsewhere for fear they won't get a fair trial in Davidson County.

thank you . There have been a lot of discrepancies in this case that we have witnessed. These were made in statements from the defendants their family and their lawyers is it possible to get a lie file for new comers
 
I second that request. I think if we could document discrepancies between these comments and actual court documents, it would enhance our discussion greatly.
 
I disagree that this case will be just about the documented hard evidence..because the defense appears to be ready to put the victim on trial. In that case, it becomes a case of credibility...a he said/she said between a dead man and his killers. I think the Prosecution will be able to bring in a lot of additional material to impeach their credibility. The Judge will ultimately rule which of those things are admissible...but remember, Scott Petersons lies were admitted into the Prosecution case...Casey Anthony's lifestyle and FB pictures were admitted into her trial...and explicit sexual videos between Chris Coleman and his mistress were viewed by the jury in his trial for his wife's death. All these trials are available for perusal on this site.

Those were cases where forensic evidence was scarce, and the case depended on circumstantial evidence.

The case was upheld on appeal.

The Prosecution will bring in whatever the Judge lets them get in. And, to your point, Scott Peterson was indeed convicted on very little hard evidence but a lot of evidence of lies and poor character. They even gave him the death penalty.

So we will have to wait and see what the Judge allows.

Here's another second degree murder trial that ended with a conviction...notice that the Prosecutor even played a TV interview to show the lies told by the defendant.


She also said Knoller lied repeatedly in grand jury and trial testimony, has never expressed remorse and "blamed the victim" in an interview with ABC's "Good Morning America" 13 days after the attack.
In that interview, which prosecutors played for the trial jury, Knoller said Whipple had ample opportunity to get back into her apartment and save herself.

Here's a second degree case where history with former boyfriend was admitted at trial...and DV rejected.

"A woman who falsely accused three Duke University lacrosse players of raping her has been found guilty of murder in the 2011 stabbing of her boyfriend.

Crystal Mangum was convicted of second-degree murder for stabbing her boyfriend in the chest during a fight in April 2011. He died 10 days later. She faces up to 18 years in prison.

Mangum claimed that she stabbed the victim, Reginald Daye, in self-defense after he allegedly beat and choked her, then dragged her by the hair out of jealousy.

“He was bigger than her. He was on top of her. He was choking her. [She gave him a] single stab wound to the flank,” Mangum’s attorney, Daniel Meier, said in court during the trial.

But according to ABC 11 News, prosecutors argued that the woman, who has a “history of physical violence toward boyfriends,” had attacked Daye.

Before he died, Daye admitted dragging Mangum by the hair, but insisted that he was trying to get away when she stabbed him."

The instructions as I read them seem at least to me to indicate that the prosecution probably has enough to convict Molly just on the autopsy report alone...IMO...what it doesn't really address is domestic violence and how that factors in but it sure helps to make the focus clearer...
 
There are , of course, many sources with information about second degree murder trials. But just in the few above, past relationships can be used to impugn the witnesses ( like KM) ; videos, journals, social media can be used to cast the defendant as a liar( past FB vs present FB) ;public statements can impeach their truthfulness ( Uncle Mike has repeatedly spoken FOR THEM with the authority of family spokesman); zero history of "documented" abuse can be argued ( does MM have documentation? ) and testimony from even 34 years ago can be admitted ( past relationships.)

The idea that the charge of second degree inhibits the prosecution is wrong. The charge itself does not limit the prosecutor ...it all depends on how the judge rules on specific inclusions.

Well, we'll wait and see. I still think think case will hinge on forensics, that will speak for themselves. The autopsy report alone is probably enough.
