This is the Bosma murder trial daily discussion thread. The trial daily discussion thread is for discussion of trial evidence/testimony only, not for general discussion, posts about past threads, other members, etc. Off-topic posts will be removed.

Note: Only testimony that is published through MSM reporting (articles and tweets) is allowed. Keep discussion focused on testimony as it becomes public knowledge and remember to link up to MSM reporting of same.

Any testimony that might remain under Publication Ban, and any courtroom discussion that takes place when the jury is not present, is strictly off-limits. Posts that violate a Publication Ban, or discussion when the jury is absent, will be removed.

The cross-examination of one of two men charged with first-degree murder continues today after Mark Smich was grilled by his co-accused's lawyer about the whereabouts of the gun that Smich believes was used to kill Hamilton's Tim Bosma.

On Monday, Smich could not remember where he buried the gun. He faced tough questions from the lawyer of co-accused Dellen Millard, but didn't have a lot of answers.

"Is this some gun burial-induced amnesia?" lawyer Nadir Sachak said. "You seem to have forgotten every detail except it's buried in some magical forest."

CLAIRMONT: The two — very different — sides of Mark Smich

This version of Smich never went to police about Tim's murder. It orchestrated a delivery of weed (and the murder weapon) from Millard's home instead. This version of Smich hid the murder weapon in his mother's home, to distance himself from it.

Then he would try to sell the gun.

"Mark Smich, could you tell the jury how much you wanted to profit from the death of Mr. Bosma?" asks Sachak. "How much was his life worth to you?"

Smich doesn't reply.

The jury must wonder what the real Smich would answer.

Millard's laywer Nadir Sachak starts by saying between May 6 and May 22, Smich doesn't contact police. Smich says that's correct.

"Smich also testified he didn't talk to Millard's girlfriend, Christina Noudga, the night Millard was arrested. Both she and Marlena Meneses, Smich's girlfriend at the time, have testified Smich spoke to Noudga, which set in motion a plan to get drugs out of Millard's house."

Could he have been mistaken, or is he sure his memory was in tip top shape? As they go through those dark days following the horrific crime we will see a trend of where his memory seems to fade. So far, he is on par with CN.

At one point, Daly recalled, Smich showed him a YouTube video about "zombie bullets," and mentioned a gun.

"He said the bullets (in the video) went with a gun he had wanted, and he'd ended up with a different one. Dell got the one he wanted," Daly said, referring to Millard by his nickname.

"The gun, Smich told him, was stashed in a toolbox. He'd had a friend move it, and it was hidden under a dryer in his mom's garage." .

From Daly's testimony, we know that Mark had his own gun.
 
"Sir you live by a code, and that code is to avoid police at all costs, correct?" Sachak says. "I sold drugs, sir," Smich says.

Smich says it wasn't a code he lived by, it's because selling drugs is illegal.

Sachak says it's his "belief system" to mistrust police. Smich says no. "You have no faith in the police, isn't that true sir?" Sachak says. Smich again says no.

Sachak now asking about Smich's aspirations to be a rapper. Smich says it started as a hobby, but he became more serious about it and wrote lines with Millard.

Sachak says Smich's raps reflect his inner most values. Smich says that's not true. "It's an art form," he says. "You raps are a diary of your inner most thoughts," Sachak says. Smich again says no.
