This is the Bosma murder trial daily discussion thread. The trial daily discussion thread is for discussion of trial evidence/testimony only, not for general discussion, posts about past threads, other members, etc. Off-topic posts will be removed.

Note: Only testimony that is published through MSM reporting (articles and tweets) is allowed. Keep discussion focused on testimony as it becomes public knowledge and remember to link up to MSM reporting of same.

Any testimony that might remain under Publication Ban, and any courtroom discussion that takes place when the jury is not present, is strictly off-limits. Posts that violate a Publication Ban, or discussion when the jury is absent, will be removed.

At all times, keep in mind Websleuths TOS, so affectionately referred to as The Rules.

There will be ZERO TOLERANCE for snarky or disrespectful posts and/or subtle digs at other members. Mods will not be PMing you with explanations, you will find your post has disappeared, or that you can no longer post.

There is to be NO name calling or name variations, not even of the accused.

There is to be no BICKERING between members. A difference of opinion is NOT a TOS violation. Some will think one or both of the accused are guilty, some will think one or both are not guilty, and some will be on the fence. All of that is okay and should NOT BE ATTACKED. If you disagree, that's fine, move past the post. If a post is offensive, alert it and let the Mods review it. If you respond to the post, both the offensive post AND yours will be removed and may result in other consequences.

Other reminders for reference as we have respectful discussion in each of the daily trial discussion threads:

Abuse of the WS Alert feature can have consequences including timeout or worse. Such abuse includes, but is not limited to:

• Overuse of the alert system

• Repeatedly alerting on the same poster

• Demanding a specific outcome

• Alerting on the same post more than once

Once you have alerted on a post, please move on without discussing it, and don't question the decisions of our Administrators, Moderators or Owners, and don't expect personalized responses with explanations about a particular decision.

The principle of “innocent until proven guilty” is for the court room … it is not required that Websleuths members adhere to that principle. Members are allowed to discuss, speculate, theorize, and judge according to opinions they develop from following the specifics of the case.

If you have any questions, PM a Mod and we will be happy to assist you. The main Mods/Admin for this trial will be Bessie, Coldpizza, and sillybilly.

Tim Bosma trial: Day 6 of cross-examination of Mark Smich
CBC News Posted: May 24, 2016

Co-accused Mark Smich returns to the witness box for a sixth day of cross-examination as the trial into the 2013 killing of Tim Bosma continues with Smich facing questions from a lawyer representing the Crown.

On Friday, the lawyer for the other accused, Dellen Millard, said his client and Smich argued over Bosma's death at Millard's airplane hangar after the shooting. That allegation was one of Nadir Sachak's final points as he completed his five-day cross-examination of Smich.

Court is now in session. The jury is being called in. Crown Craig Fraser will begin his cross-examination.
by Adam Carter 10:00 AM

"The plan that you and Dellen Millard had was to steal, was to kill, and was to burn," Fraser says. "No sir," Smich says. Fraser says that's the plan he and Millard executed with "chilling perfection."
by Adam Carter 10:03 AM

Fraser says it was a long time in the making, for over a year.
by Adam Carter 10:03 AM

"There wasn't anybody else there, Mr. Smich. It was you and Mr. Millard," Fraser says, his voice rising.
by Adam Carter 10:04 AM

"Tim Bosma is dead, Tim Bosma is incinerated, and his truck is gone," Fraser says.
by Adam Carter 10:04 AM

This is the most forceful I've seen Fraser be with a witness so far at this trial.
by Adam Carter 10:05 AM

Fraser says Smich's justification for working with Millard after May 6 was fear. Smich agrees.
by Adam Carter 10:06 AM

Fraser now pointing out at the end of Millard's lawyer's cross, that suggested Smich had a "conscious, deliberate mind" for certain actions.
by Adam Carter 10:07 AM

Fraser says he's going to show how Smich and Millard worked together to cover up the crime.
by Adam Carter 10:07 AM

Fraser says Smich switched the plates on Bosma's truck. Smich agrees.
by Adam Carter 10:08 AM

Fraser says that Smich went down to the road at Millard's farm to make sure no one had followed. Smich agrees.
by Adam Carter 10:08 AM

Smich agrees it's a fact that he helped Millard hitch the eliminator to the truck. "The two of you were working together in execution of the plan," Fraser says. "No sir, that was not the plan," Smich says.
by Adam Carter 10:10 AM

Fraser now talking about the video of Smich and Millard walking in the hangar. He says there was no confusion in that walk -- they were "calmly going about their business." "It was a stroll," Fraser says. Smich disagrees.
by Adam Carter 10:12 AM

Fraser says that Smich destroyed evidence by stripping the truck. Smich agrees he did.
by Adam Carter 10:12 AM

Fraser now talking about how Smich hosed down Bosma's truck.
by Adam Carter 10:13 AM

"That is you hosing down the very vehicle Mr. Bosma was killed in ... that's destroying evidence, right?" Fraser says. "That's correct, sir," Smich says.
by Adam Carter 10:14 AM

Fraser now talking about when Smich and Millard removed the seats of Bosma's vehicle.
by Adam Carter 10:15 AM

"It's the two of you doing it, working together to cover up a crime," Fraser says. "Essentially, that is correct sir," Smich says.
by Adam Carter 10:16 AM

Fraser now mentioning when Smich and Millard took the pieces stripped from Bosma's truck and put them in the Millard's truck. "You burned it at the farm ... the two of you went to the farm and burned evidence," Fraser says. Smich again agrees that is a fact.
by Adam Carter 10:17 AM

Impressed how Craig Fraser is sharply focused on both DM and MS being complicit in the theft, murder and aftermath.
Crown has the luxury of linking DM during this cross, that DM lawyers did not have.

Fraser now talking about May 7. "I didn't want to be involved, I was just pretending to go along with everything," Smich says. Fraser says we've heard his "justifications and excuses."
by Adam Carter 10:19 AM

"You were all in, Mr. Smich. You took that Eliminator out to the barn and you stuck it there away from prying eyes," Fraser says. Smich agrees they moved it on the 7th.
by Adam Carter 10:20 AM

Fraser says Smich and Millard were at the hangar for two and a half hours on May 7. Smich says if that's the evidence, he agrees.
by Adam Carter 10:21 AM

"The other thing that was going on at that hangar for two and a half hours is you had to clean the Eliminator," Fraser says. He says it was too hot on May 6, so they had to do it that night. Smich says no. "There were other things that were being done, I can't recall exactly," Smich says.
by Adam Carter 10:22 AM

"You had a whole lot of cleaning up to do with the remains of Mr. Bosma in the bottom of that Eliminator," Fraser says. "That's not what happened," Smich says.
by Adam Carter 10:23 AM

Smich agrees he and Millard did drop off the Eliminator at the barn that night.
by Adam Carter 10:24 AM

Fraser says the plan was to go back on Wednesday and burn evidence at the farm. Smich says "from what I recall, that's what he was saying." It didn't happen, but that was the plan.
by Adam Carter 10:25 AM

"You were going to burn evidence in a murder investigation, the two of you," Fraser says.
by Adam Carter 10:25 AM

That burning did happen on the Thursday.
by Adam Carter 10:26 AM

"I agree, yes, we were destroying evidence," Smich says.
by Adam Carter 10:27 AM

Fraser moving to Thursday, May 9.
by Adam Carter 10:27 AM

Smich previously described "pretty much a full day on May 9, because of the events that took place," Fraser says.
by Adam Carter 10:28 AM

Finally the question is asked about cleaning out the eliminator!

All MOO.

"The only thing the two of you were doing is you're working together to destroy and conceal evidence of the events, as you described it," Fraser says.
by Adam Carter 10:29 AM

Smich testified that that day he and Millard got gas in little red canisters and then went to the farm. "You had the presence of mind to get little red canisters of gas to use it as an accelerant," Fraser says.
by Adam Carter 10:30 AM

Fraser says they burned those pieces out of the way, on the back of the farm. "You wouldn't want to make it obvious, would you?" Fraser says. "That's the spot he chose," Smich says.
by Adam Carter 10:31 AM
