This is the Bosma murder trial daily discussion thread. The trial daily discussion thread is for discussion of trial evidence/testimony only, not for general discussion, posts about past threads, other members, etc. Off-topic posts will be removed.

Note: Only testimony that is published through MSM reporting (articles and tweets) is allowed. Keep discussion focused on testimony as it becomes public knowledge and remember to link up to MSM reporting of same.

Any testimony that might remain under Publication Ban, and any courtroom discussion that takes place when the jury is not present, is strictly off-limits. Posts that violate a Publication Ban, or discussion when the jury is absent, will be removed.

At all times, keep in mind Websleuths TOS, so affectionately referred to as The Rules.

There will be ZERO TOLERANCE for snarky or disrespectful posts and/or subtle digs at other members. Mods will not be PMing you with explanations, you will find your post has disappeared, or that you can no longer post.

There is to be NO name calling or name variations, not even of the accused.

There is to be no BICKERING between members. A difference of opinion is NOT a TOS violation. Some will think one or both of the accused are guilty, some will think one or both are not guilty, and some will be on the fence. All of that is okay and should NOT BE ATTACKED. If you disagree, that's fine, move past the post. If a post is offensive, alert it and let the Mods review it. If you respond to the post, both the offensive post AND yours will be removed and may result in other consequences.

Other reminders for reference as we have respectful discussion in each of the daily trial discussion threads:

Abuse of the WS Alert feature can have consequences including timeout or worse. Such abuse includes, but is not limited to:

• Overuse of the alert system

• Repeatedly alerting on the same poster

• Demanding a specific outcome

• Alerting on the same post more than once

Once you have alerted on a post, please move on without discussing it, and don't question the decisions of our Administrators, Moderators or Owners, and don't expect personalized responses with explanations about a particular decision.

The principle of “innocent until proven guilty” is for the court room … it is not required that Websleuths members adhere to that principle. Members are allowed to discuss, speculate, theorize, and judge according to opinions they develop from following the specifics of the case.

If you have any questions, PM a Mod and we will be happy to assist you. The main Mods/Admin for this trial will be Bessie, Coldpizza, and sillybilly.

Tim Bosma trial: Mark Smich cross-examined by Crown for 2nd day

Mark Smich returns today for a second day of cross-examination by a Crown lawyer who told jurors Tuesday that Smich and co-accused Dellen Millard planned to kill Hamilton resident Tim Bosma after months of planning.

Craig Fraser also said Millard and Smich planned all along to kill Bosma so they could steal his pickup truck, and then burn the body.

Fraser's questions Tuesday focused on pieces of evidence that suggested months of planning by the pair before Bosma's death, and on their efforts to cover it up afterward.

Back at the courthouse today as the Crown continues its cross-examination of Mark Smich.
by Adam Carter 9:35 AM

Court started at 9:30 a.m. This morning for a legal argument, with the jury expected in at 10.
by Adam Carter 9:41 AM

Because several people have asked me, here's the next few steps in the trial.

The Crown expects to finish its cross today, and then Smich's lawyer Thomas Dungey will have the opportunity to re-examine his client.

Once that's complete, Smich should finish his evidence. Dungey then has the opportunity to call other witnesses. We don't know if he will or not.

After Dungey finishes with his defence, the Crown can call a rebuttal if the defence has raised some new matter or evidence that the Crown had no opportunity to deal with earlier in the trial.

After that, the Crown and the defence will give closing submissions to the jury. All of the lawyers will also meet with Goodman for a two-part "pre-charge conference," where his final charge to the jury is discussed.

Though we're closing in on the end of the trial, it's not finished just yet.

Two phones is where they left off one at 920, the other at 923. Fraser suggests it was more plan than coincidence. Smich disagrees. #Bosma

Colin Butler ‏@ColinButlerCBC 56s56 seconds ago

Susan Clairmont ‏@susanclairmont 55s55 seconds ago

"Who comes this late to see a truck?" was one of the things Bosma said to his wife that night. Also commented about it getting dark.
by Adam Carter 10:30 AM

Fraser says it's clear from those exchanges that Bosma was on "high alert" and was suspicious. Bosma had also said "Should I go with them?"
by Adam Carter 10:31 AM

Fraser asks if it's fair that Bosma felt that way. Smich's lawyers object.

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago

molly hayes ‏@mollyhayes 1m1 minute ago

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Fraser: "When (Tim) leaves that driveway he's not very comfortable, is he?" Dungey objects, says Smich being asked to speculate. #Bosma

molly hayes ‏@mollyhayes 49s49 seconds ago
Dungey objects. Says Fraser is asking Smich to speculate on other people's testimony. #Bosma

Colin Butler ‏@ColinButlerCBC 49s50 seconds ago
Fraser suggests #TimBosma was on high alert and suspicious and he asks Smich if it was a suspicious situation. Dungey objects. Jury leaves.

Lisa Hepfner ‏@HefCHCHNews 49s50 seconds ago
Fraser says it was a highly suspicious situation that would put a person on high alert. Wasn't #TimBosma? Jury excused while lwyrs discuss

Susan Clairmont ‏@susanclairmont 39s40 seconds ago
Crown says it's reasonable for Smich to comment on that body of evidence. Not on #Bosma's thoughts. Judge interrupts and asks jury to leave.

So curious where Fraser is headed with this line of questions.
