    Bosma Murder Trial 06.1.16 - Day 57 - Closing Arguments Day 2

This is the Bosma murder trial daily discussion thread. The trial daily discussion thread is for discussion of trial evidence/testimony only, not for general discussion, posts about past threads, other members, etc. Off-topic posts will be removed.

Note: Only testimony that is published through MSM reporting (articles and tweets) is allowed. Keep discussion focused on testimony as it becomes public knowledge and remember to link up to MSM reporting of same.

Any testimony that might remain under Publication Ban, and any courtroom discussion that takes place when the jury is not present, is strictly off-limits. Posts that violate a Publication Ban, or discussion when the jury is absent, will be removed.

At all times, keep in mind Websleuths TOS, so affectionately referred to as The Rules.

There will be ZERO TOLERANCE for snarky or disrespectful posts and/or subtle digs at other members. Mods will not be PMing you with explanations, you will find your post has disappeared, or that you can no longer post.

There is to be NO name calling or name variations, not even of the accused.

There is to be no BICKERING between members. A difference of opinion is NOT a TOS violation. Some will think one or both of the accused are guilty, some will think one or both are not guilty, and some will be on the fence. All of that is okay and should NOT BE ATTACKED. If you disagree, that's fine, move past the post. If a post is offensive, alert it and let the Mods review it. If you respond to the post, both the offensive post AND yours will be removed and may result in other consequences.

Other reminders for reference as we have respectful discussion in each of the daily trial discussion threads:

Abuse of the WS Alert feature can have consequences including timeout or worse. Such abuse includes, but is not limited to:

    • Overuse of the alert system

    • Repeatedly alerting on the same poster

    • Demanding a specific outcome

    • Alerting on the same post more than once

Once you have alerted on a post, please move on without discussing it, and don't question the decisions of our Administrators, Moderators or Owners, and don't expect personalized responses with explanations about a particular decision.

The principle of “innocent until proven guilty” is for the court room … it is not required that Websleuths members adhere to that principle. Members are allowed to discuss, speculate, theorize, and judge according to opinions they develop from following the specifics of the case.

If you have any questions, PM a Mod and we will be happy to assist you. The main Mods/Admin for this trial will be Bessie, Coldpizza, and sillybilly.

    Bosma Murder Trial 05.31.16 - Day 57 - Closing Arguments Day 2

Tim Bosma trial: Mark Smich's lawyer makes his closing argument
CBC News Posted: Jun 01, 2016

    link

Mark Smich's lawyer, Thomas Dungey, starts making his closing argument Wednesday defending his client, one of the two men accused of killing Hamilton man Tim Bosma.

In court Tuesday, jurors heard Dellen Millard's lawyer say his client wouldn't have left behind so much damning evidence if he were planning a murder. Ravin Pillay said Millard is an intelligent person and wouldn't have acted if he had planned to kill.

"The murder was not planned and deliberate," Pillay told the first day of closing arguments.

Day 2 of the "blame game" most likely. Anticipate the same story, but different person being blamed today - DM - let's see if Dungey has a stronger gift of persuasion and logic - perhaps better than what Pillay had to work with in his closing yesterday.

How can there be a legal argument now?! Can the lawyers not say whatever they want as long as they don't bring up evidence that is disallowed?

"The murder of Tim Bosma is a heinous and despicable crime," Dungey says.
    by Adam Carter 9:38 AM

"it strikes at the very heart of all of us," Dungey says. "That could have been you, that could have been me, it could have been any of us."
    by Adam Carter 9:39 AM

That's why the attention has been so high, he says.

Dungey says Bosma was killed by "a madman at the moment. For what reason, we will never know."
    by Adam Carter 9:40 AM

"Mark Smich does not have to prove his innocence ... the Crown must discharge that proof beyond a reasonable doubt."
    by Adam Carter 9:40 AM

"If you are sure of the guilt of Mr. Smich, you must convict. If you are not sure, then you must find him not guilty. That's the basic law."

"You are the judges of the facts. Only you."
    by Adam Carter 9:41 AM

Dungey tells the jury anything lawyers say is not evidence. Only testimony is, and they have to determine the facts.
    by Adam Carter 9:42 AM

Dungey also points out Pillay played "small portions" of transcripts yesterday. "Don't accept one little portion. Look at the totality of the evidence."

Dungey points out that he said to Christina Noudga that she had a self interest to not say negative things about Millard.
    by Adam Carter 9:44 AM

"An accused can testify ... and in this case, Mr. Smich testified," Dungey says. "It's not because we think the Crown has proven its case at all."
    by Adam Carter 9:46 AM

"Only two people could tell us what transpired on May 6 and 7 ... that is the only evidence we have as to what happened."

"You have a multitude of suggestions made by Mr. Pillay's counsel in cross examination ... that's not evidence."
    by Adam Carter 9:46 AM

"It's merely a scenario. No evidence. None."
    by Adam Carter 9:47 AM

Dungey points out Smich was cross-examined for 7 days, and that it wasn't easy. "He was hammered and hammered and hammered ... every little stone was turned over."
