    Probable cause existed for arrest in Lee County girl’s disappearance

    Lee County Sheriff’s deputies had probable cause to arrest a man on kidnapping charges after the disappearance of a 9-year-old girl from her San Carlos Park home, court documents show.

    But Jorge Guerrero, who was named in the AMBER Alert for Diana Alvarez, was instead arrested in a child pornography case. Graphic images of Alvarez were found on a cellphone belonging to Guerrero.

    The lack of an arrest related to Alvarez’s May 29, 2016 disappearance could be a strategic move related to a possible plea agreement, said Lance Dunford, a Fort Myers attorney who isn’t connected to the case.

    Prosecutors will not be allowed to mention Jorge Guerrero as a suspect in Diana Alvarez’s kidnapping or mention his whereabouts at the time of her disappearance during his child pornography trial, a federal judge ruled on Tuesday.

    But prosecutors will be allowed to show interrogation video of Guerrero, who is accused of possessing lewd images of the nine-year-old girl, admitting to a sexual relationship with Diana.

    At lunchtime, attorneys had selected 12 possible choices, while excusing 24 others, the majority of whom said they were familiar with Guerrero-Torres as a suspect in the disappearance of Diana.

    At least 18 of the 24 people excused so far were given a reprieve after they admitted they were familiar with the girl's name. The remainder had scheduling conflicts.

    Federal child porn trial for Guerrero underway

    A jury was seated Friday afternoon in the federal child pornography trial against Jorge Guerrero, also accused in the disappearance of Diana Alvarez.

    In opening statements, the government described it as a case of betrayal after Guerrero lived in Diana's family home and took advantage of the circumstances. The defense suggested the jurors should consider whether the photos involved are in fact pornographic images that involved a child.

    Four witnesses, members of the Florida Department of Law Enforcement and the Lee County Sheriff's Office, were heard during the first hour of the jury taking their seats.

    We do know before the trial started, Guerrero had no interest in accepting a plea deal that would ensure him a lower sentence.

    The jury was released for the weekend after the government moved through a quick four witnesses before 5 p.m.

    The court is in recess now until first thing Monday morning. It's expected to last nearly a week.



    'A case about betrayal': Trial begins for Diana Alvarez suspect

    [U.S. Attorney Jesus] Casas’ opening statement told the story of Guerrero-Torres, a man who “claimed he loved Diana and that she loved him,” Casas said. Guerrero-Torres, the prosecutor said, rented a room in the home of Diana’s parents and during that time he would go into Diana’s room and “the two would do things."

    Keep an open mind,” Roger Azcona, Guerrero-Torres’ attorney, said during opening statements. “When you see and hear the evidence, you will see the government will not meet their burden.”

    A Florida Department of Law Enforcement agent had already interviewed Guerrero-Torres once on the day Diana went missing. Two days later, on May 31, 2016, Lee County Sheriff's Office Detective Fortunato “Fred” Mazzotta boarded a helicopter and landed in an Orlando municipal airport. He was scheduled to meet with the man about the missing child case.

    But in the almost 20-minute ride from the airport to Guerrero-Torres' home, the defendant fled, Mazzotta testified. But, Guerrero-Torres left behind his phone. He threw it into a flooded swill about a mile away from his apartment, Mazzotta said. It was later found by a landscaper.

    "Some of those images were of immediate concern," Casas said.

    The photograph, Casas said, is child pornography.

    Azcona countered that it’s up for the jury to decide whether the image depicts child anatomy.

    Guerrero-Torres was finally captured in Okeechobee on June 3 after a woman who was asked to help him flee turned him in instead, Casas said. Her husband saw Guerrero-Torres was wanted by law enforcement after he fled his Orlando apartment to Okeechobee. The woman, named Antonia Aguilar, was directed to pick him up and after she did, the vehicle they were in was pulled over by waiting law enforcement.

    Mother of missing San Carlos Park girl collapses in court

    Rita Hernandez began sobbing moments before her collapse, which took place just as she was about to speak with reporters in the minutes after court recessed for the day. Hernandez was quickly helped to her feet and was able to leave the courthouse without assistance.

    She testified in Spanish about what she called an affectionate relationship that had been developing between defendant Jorge Guerrero and Diana Alvarez, the missing girl. Guerrero is accused of possessing lewd images of Diana, who was 9 when she went missing nearly a year ago. He has not been charged in her disappearance.

    The prosecution plans to show those photos to the jury on Tuesday. Prosecutors will also be allowed to show interrogation video of Guerrero admitting to a sexual relationship with Diana.

    Man linked to missing girl found guilty in child porn trial

    Jorge Guerrero was linked to lewd images of Diana Alvarez, who was 9 when she went missing nearly a year ago.

    “This is a key component to finding where Diana is,” said Tom Busatta, an attorney for Diana’s family.

    Some jurors shook their heads, covered their mouths and looked away Tuesday as prosecutors showed seven graphic photos that Guerrero admitted were of him and Diana.

    The prosecution and defense rested and made closing arguments Tuesday afternoon and the jury deliberated for less than 30 minutes.

    The family of Diana Alvarez spent Wednesday celebrating their oldest daughter, despite the continued search for the now-10-year-old.

    Rita Hernandez, Diana's mother, cracked a quick smile as she reminisced about Diana's birthday last year, when the little girl asked for her favorite dish and then the family had cake. Two weeks later, she was gone.

    Most difficult of all for Gibson was finding out after the trial that Alvarez still hasn’t been found. He was only vaguely familiar with the case before the trial, and prosecutors weren’t allowed to mention Alvarez had gone missing.

    Search to resume for missing San Carlos Park girl

    Two volunteer organizations announced their decision Friday to renew the search for Diana Alvarez next week, the day after the one-year anniversary of her disappearance.

    The search will begin Tuesday near her San Carlos Park home, where Diana was last seen on May 29, 2016. The organizations will retrace the path investigators believe Jorge Guerrero took when he fled Lee County.

    The organizations plan to use new technology some law enforcement agencies don’t possess, including two kinds of K-9s and cadaver dogs, as well as high-tech sonar equipment to search deep below bodies of water.

    Tuesday morning, almost a year after that encounter, Case and several other Peace River searchers and their dogs joined in a renewed search for Diana, fanning out around that same San Carlos Park community.

    Looking around the Sheltering Pines trailer park just off U.S. 41, dogs and handlers walked through weedy, brushy, mosquito-infested woods, along sunlit streets, backyards, front yards, wood piles, trash piles and just about everywhere.

    Reverand Sarah Witten-Grigsby, public information officer and chaplin for Peace River K9 Search and Rescue, said the dogs and handlers were part of 12 such teams that were searching for evidence of Diana across the state.

    Other crews are continuing to search along the travel route officials believe suspect Jorge Guerrero-Torres took.

    Drones at work in search for missing San Carlos Park girl

    Crews from a pair of volunteer organizations picked up the search this week for Diana Alvarez one year after her disappearance.

    “Some areas of interest have been found” in regard to Diana’s whereabouts, said Sarah Whitten-Grisby, a spokeswoman for Peace River K-9 Search and Rescue, one of the groups involved in the renewed search.

    The crews are looking near the Alvarez home, as well as in areas near Okeechobee, Moore Haven and Indiantown in accordance with records from the cellphone of former family friend Jorge Guerrero, who’s suspected of taking her.

    Team looking for Diana Alvarez has new information

    [The Peace River K9 Search and Rescue team] say they uncovered DNA that has them planning a search this weekend in the Okeechobee area.

    The family's attorney said a "DNA detector" alerted the team to two areas, one in Lee County and the other near Indiantown, south of Okeechobee. They used a DNA sample from Diana's brother, who has the same mother and father as Diana, to make the connection.
