Shirley Carter, 68, was found shot to death at her home at 132 Perry Street in rural Lacona about 17 miles southwest of Knoxville on June 19.

Marion County Sheriff Jason Sandholdt said Carter was shot with a rifle, according to the autopsy report...

Carter claims his own son killed his wife. Earlier this year, he and his two other children filed a wrongful death suit alleging Jason Carter is responsible for their wife and mother's death.

Jason Carter's attorney called the claims made in the civil suit "outrageous."

In his opening statement Tuesday, the attorney for Bill Carter told the jury that he would show the audience that Jason Carter lived a reckless lifestyle, had at least one affair, was deeply in debt, and allegedly killed Shirley Carter to gain access to his parent’s approximately $10 million dollars in assets.
 
The acrimony in the Carter family was so severe that before the trial, the two sides jointly asked for increased security in the courtroom during the trial, citing concern "that tensions may be high enough to lead to confrontations between plaintiffs’ supporters and defendant’s supporters."

The criminal complaint says investigators found evidence of a staged burglary inside the Carter home after Shirley was killed and Jason called 911. The state of the home was one of several points of emphasis for plaintiffs in the civil trial. Attorneys argued that Jason Carter was in financial trouble and hoped to inherit his parents' estate.

Carter was under surveillance when he stopped at a service station Sunday afternoon and authorities moved to take him into custody. Carter was due to appear in Marion County District Court later Monday morning. His attorney said Sunday that he denies killing his mother.

Jason Carter’s Attorney Asking For New Civil Trial in Death of his Mother

Attorneys for Jason Carter are asking a judge to vacate the judgment in his civil trial or grant a new trial.

A petition requesting the new trial was filed this afternoon in Marion County. It is based on new evidence uncovered during the discovery phase of the criminal case. The new evidence point to at least two other individuals believed to be responsible for killing Shirley Carter during a botched burglary at the Carter home in 2015.

Those individuals, Joel and John Followill are named in the brief, as are other, possible accomplices.

New Audio Files Point to Other Potential Suspects in Carter v. Carter Case

It’s information that could have been crucial during the civil trial, but is now being released as Jason Carter prepares to defend himself against a murder charge. The interviews were part of the DCI investigation into Shirley's death, and they conflict with some of the testimony during the civil case.

One audio recording is between Bill Carter--Shirley's husband and Jason's father--and DCI just days after Shirley’s death.

"KNOXVILLE — Nearly six months after Jason Carter was found liable of killing his mother, he and his father, along with their attorneys, were back in court Thursday to untangle efforts aimed at overturning that verdict.

All that emerged was a pledge from District Judge Martha Mertz to reconsider her recent decision not to act on a motion to vacate the December civil trial jury’s verdict until the Supreme Court rules on Carter’s appeal of the case.

Mertz said she’d make her next step known soon, but indicated she’ll schedule a conference in 60 to 90 days to revisit the status of the case. In that span, it’s possible that the high court could act on the appeal...."

District Court to determine if Jason Carter judgment should be vacated

"KNOXVILLE - A Marion County Judge has ordered a hearing to determine whether or not judgment against Jason Carter should be vacated.

In a Tuesday morning ruling, Judge Martha Mertz writes that the court "has considered each party's argument, has done additional research, and concludes it is in everyone's best interests for the Court to consider Defendant's Petition to Vacate now". ...

Judge Mertz wrote in a June 14 order that "the district court must await the outcome of the appeal". However, an October 10 order from the Supreme Court of Iowa stated that "The appellate proceedings are stayed pending the district court’s ruling on the appellant’s motion to reconsider".

According to court documents, the hearing in Marion County must be set no later than 20 days from October 16. If not set within 20 days, Judge Mertz has ordered the hearing happen no later than December 31."

"A hearing will be set in Marion County on the civil suit against a man who was found liable in the shooting death of his mother, and faces criminal charges in the same matter.

A motion for a hearing on the defense’s request to vacate the jury’s verdict in the case against Jason Carter was granted on Tuesday; District Court Judge Martha Mertz issued that ruling in the civil case brought about by his father Bill and brother Billy, asserting Carter shot his mother Shirley to death....

If the new hearing isn’t scheduled within 20 days of the ruling, one will be ordered before the end of December."

Lawyers hash out rules for Carter verdict review

"KNOXVILLE — Attorneys ironed out the ground rules Wednesday for a Dec. 10-11 hearing that will determine whether Jason Carter will get a second chance in a civil case that found him liable for his mother’s wrongful death.

Carter’s attorneys on May 31 asked that the $10.2 million verdict be overturned, saying that new evidence has emerged that will exonerate him. The evidence they pointed to came from Iowa Department of Criminal Investigation documents prepared for Carter’s criminal trial, which will begin March 4.

Since May, the civil case’s outcome has been tangled between an appeal to the Iowa Supreme Court and Carter’s bid to have a jury’s verdict tossed out. District Judge Martha Mertz said Oct. 16 that she’d consider Carter’s request.

Most of wrangling in a preliminary hearing Wednesday focused on efforts by attorneys for Bill Carter, Jason’s father and a plaintiff in the civil case, to get an early look at the DCI files. Attorney Mark Weinhardt argued that his team see everything that was compiled in the criminal discovery process. In May, Jason Carter’s legal team claimed that two men, possibly working with an accomplice, killed Shirley Carter on June 19, 2015 during a failed attempt to steal opioid patches and pills....

Mertz gave attorneys a Dec. 5 deadline to file motions to exclude evidence and told Weinhardt to provide Carter’s team by Dec. 7 with a list of evidence he might introduce or witnesses he might call during the hearing."
