    KY - Arthur Mattingly, 16, shot to death, Louisville, 21 June 2004

    The sentencing of a Louisville man did not go as expected Monday. Derek Wright was to begin serving prison time for killing a 16-year-old last June. WAVE 3's Carrie Weil explains.

    Derek Wright cut a deal with the Commonwealth to plead guilty to manslaughter and a list of other charges in exchange for a 10-year prison sentence.

    Wright is accused of shooting 16-year-old Arthur Mattingly in his Portland neighborhood in June of 2004. The prosecutor tells us she believes the two were fighting over a girl

    Downey says, accoreing to the agreement, if Wright "violated any of the terms of his release or if he failed to appear today, he agreed to serve 17 years, which were the sentences on both cases run back to back. And he forfeited the right to ask for probation or for shock probation."

    Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?
