Woman went missing in southwest Bakersfield Sunday

Bakersfield Police Department is searching for a missing adult last seen on July 17 at 6800 Slickrock Drive in southwest Bakersfield.

And before the end of the night, they also watched Bakersfield police tow away Rosa Garibay's vehicle, and two other cars at her home.

According to the video at the below link, the other two vehicles were her husbands work van and her son's car.

Neighbors told 17 news that Garibay's husband said all of her possessions were still in the home, including her cell phone and her car. She was last seen in her silver creek neighborhood on Sunday, wearing a black blouse and shorts.

One wonders how many times he abused her before and after he was arrested in 2015.

Gonzalo Garibay was previously arrested May 12, 2015 on inflicting corporal injury on a spouse charge, but those charges were dropped on January 8, 2016.

The Bakersfield man accused of killing his wife and dumping her body in Ventura County last July will stand trial.

Gonzalo Garibay, 44, pleaded not guilty to first-degree murder in the death of his wife Rosa.

The judge concluded the hearing by upholding the first-degree murder charge against Gonzalo Garibay for the death of his wife, Rosa Garibay.

Gonzalo Garibay is scheduled to be back in court February 14. That's when a trial date is expected to be set.
 
Garibay takes the stand in his defense

On the stand he described the state of his marriage with Rosa Garibay and described again the fight that lead to his wife’s death.

“She slapped me," Gonzalo Garibay said. "And we were still arguing and I was so mad and pissed, I went ahead and slapped her back. And then she punched again, punched again. And then that’s when I just didn’t know what I was doing at the time and I just got her from the neck and pushed her back.”

Prosecution shows video of Garibay caving to investigators

Prosecutors resumed the long video, they started Wednesday, of Gonzalo Garibay talking with investigators. That video was recorded four days after Rosa Garibay died in 2016. And started as a missing person investigation. Also Garibay was not under arrest at the time.

The portion of the video showed Thursday showed Garibay eventually caving to investigators over ten hours after he started talking with them. Police reports stat, Garibay later agreed to show police where his wife’s body was located around 2:30 in the morning.
 
Gonzalo Garibay spends day being cross examined

Gonzalo Garibay spent the day on the stand being cross examined by the prosecution. It was a very matter of factually exchange between the two until they got to when he said he killed her. That’s when it got emotional.

According to a forensic pathologist who testified in court, Gonzalo Garibay's wife, Rosa, died from strangulation. Tuesday the prosecution questioned Garibay on what happened during those final moments of Rosa Garibay's life.

The deputy district attorney, Tamara Tuivaiti, opened her closing arguments saying, “Rosa Garibay spent the last moments of her life, fighting for her life. Just as she predicted, at the hands of the defendant.”

The prosecution argued Gonzalo Garibay knew exactly what he was doing when he killed his wife Rosa. The prosecution pointed to the coroner’s testimony that Rosa died from strangulation and had the bone in her thyroid cartilage broke as proof this was not an accident and he thought it was justified.

The defense countered with saying Gonazlo Garibay was provoked by Rosa to act in the heat of passion. Catching her at the motel and the argument they had in their home provoked him to act. But, killing her was not his plan.

Suspecting his wife was having an affair, Gonzalo Garibay placed a cellphone in her car and tracked its movements by GPS.

He found her vehicle parked outside a motel and booked a room for the night where he could watch it. The next morning, he confronted his wife, Rosa Garibay, and a man as they left a room together. A brief fight ensued, and the parties then went their separate ways.

Within hours, Rosa Garibay, 41, was dead.

On Friday, Gonzalo Garibay was sentenced to 15 years to life in prison for strangling his wife at their house, then dumping her body down a steep embankment near Highways 33 and 66.

Her sister who now has custody of the two young children begged the judge to sentence Gonzalo Garibay to life in prison. In the end, the judge has no say, as the sentence of 15 years to life is regulated by state law.

"I would prefer him to stay there forever. it's basically saying my aunt was only worth 15 years. everything is different, everyone is depressed all the time, my family can't be happy without her", said Rosa's niece, Maria Aguilar.

With time served, Gonzalo Garibay will eligible for parole in about 13 and a half years. During the sentencing, Rosa's family asked for a protective order against Gonzalo Garibay, which the judge agreed to.
