ID - 5-Year-Old Victim’s Father Saw Video of Twin Falls Refugee Rape

I can't seem to find a discussion forum on this horrific crime and cover up. It occured this summer.

Facts and follow up are hard to come by - speculating because it brings up ancillary hot topics, such as the growing industry of bringing in refugees, small town politics, medical mafia in the state of Idaho, to bring up a few.

The family is low income, and according to local rumor either cannot afford to move, and continue to live in the same complex as the 3 refugee assailants, ages 7, 10 and 14, have been threatened by some Muslims, and the authorities have told her not to talk about it. She has NO police protection, she is (was) living in a low income housing and can ill afford this.

It appears there is a concerted effort to try and muddy the waters to keep this crime from blowing up.

“More than a month after her 5-year-old daughter was allegedly raped by a child refugee from Iraq, Laney Shelly of Twin Falls, Idaho, says her little girl is still traumatized by the incident while local authorities have denied her access to basic documents such as the 911 transcripts, police and medical reports.

The Twin Falls mother also stands by initial reports, denied by police, that it took officers more than two hours to arrive on the scene after they were called to the Fawnbrook Apartments on June 2.
Meanwhile the family of one of the alleged perpetrators, a 7-year-old Iraqi refugee, continues to live next door to his victim despite having been served with an eviction notice.”

I don't know that there is a cover up. The officials are self described conservatives, and it involves minors. I think anti immigrant and refugee activists have seized on this case and are trying to blow it up, not that government officials are trying to cover up criminal actions. JMO

“As victims it just makes us feel like they’re treating us like we’re the criminals. I called the victim’s advocate a few times to get the records and she said ‘I told you several times now you can’t have nothing.’ And she’s like ‘why do you want this stuff?’ And I tell her because it’s my daughter and I want to know and I have a right to it under our Constitution.”

Article 1 Section 22 of the Idaho Constitution lays out 10 rights of victims that cannot be violated, and number 9 on the list is the right “to read presentence reports related to the crime.”
Whether that requires a printed copy is not clear, but it would indicate the victim has the right to at least read the reports, said Guerry, the local attorney.

“I think those things should be made available to the family. They’re all personal, medical records about yourself. You can always request medical records about yourself,” Guerry said, regardless of whether a case is sealed by a judge. “This is a little girl, and in this case her parents should be getting the medical records, they should be getting the 911 report. They should be able to request that and at a minimum they should be able to sit down with the prosecutor or deputy prosecutor and review all the files, that’s just respect and fairness to the victim. Whether they continue to stonewall on that, I imagine they will, but the state Constitution does have certain guarantees.”

Because the prosecutors don't release all their info to anyone prior to adjudication of the case. The parents will know all that later. They need to meet their daughter's medical and emotional needs for now. The parents are not prosecuting the case. And in a lot of cases, trials and sentences are not completed for four years or more. I am making no comment on refugees or any political aspects of the case.
How can they read pre-sentencing reports if no trial has taken place?

The rumors and hysteria surrounding this case is terrifying. I encourage you to research this case, because young syrian refugess did not rape the girl. Here is a pretty good article about it. You can also look at snopes. (I only suggest snopes, because their article on this case includes citation and links and that's really convenient.

This article does an excellent job of stating the rumor and then providing a named source stating the actual legal facts as known. As the principals involved are all 14 years of age and younger, the full details will never come out from a court source. But the chief LEO in that jurisdiction states,"there were no Syrians involved, no refugees involved, no rape, sexual assault, or murder, no knife involved." There was an incident on that date, at those apartments, involving 4 minors. No language barrier with anyone involved.

Thank you for providing facts. I'm a big fan of Snopes for checking stories. It's sad to have to use it for news stories instead of just for stupid forwarded email stories.

It is absolutely terrifying and disgusting to see a small group deliberately capitalize on a young child's horrible experience in order to promote their agenda, especially using falsehoods to create fear. Shame on them for hijacking this little girl's experience for their own ends! Faux news is very dangerous. In this case it could foment violence toward people because of their religion and nationality. I encourage everyone to check sources and agendas behind stories before spreading them.
