With limited legal knowledge and after reading the tweets reporting on the Prosecution vs the Defence arguments, at this stage of the trial I have no other choice but to vote 'Not Guilty'.
 
I voted guilty - manslaught.

I read the body building forum today that GT posted on.....what a loser. His MO is all over that site......sex on the balcony, starting arguments to see how things go....etc etc etc

His is liable....she was in his care at his home.....he fought with her.....took her stuff and wouldn't leather leave....he is a psycho.
 
Guilty. Would Warriena, on her own in her own apartment, have decided to just sling herself off a balcony, even if extremely intoxicated? No, it was because of the defendant, his words and his actions.

Guilty.

my foundation of belief = Intent. Intent is 90% of the law, in being charged, being on trial, being convicted. What was Gabe's intent?. luckily, he tells us himself, although he is erratic, he does tell us. He tell us, and Warriena, she is bloody lucky he doesn't toss her off the balcony. Then he tells her he is escorting her out the door. Then he tells her , and us, he is not letting her out, because she is a bad girl.

What would an ordinary woman on the Gold Coast Light Rail believe?? this is the key , and it is my contention that she would believe , due to his words, his savage delivery of those words, his conveyed intent, that he was indeed going to chuck her off the balcony. It isn't up to the victim to try and unravel the erratic utterances of Gabe, she obviously reacted to the action, ( shoving her out on the balcony ) with the threat.. and this is a rational conclusion she has reached. It is horrible and unthinkable but Warriena has every reason to believe these two events. He says he is going to do it, and he begins to do it. <-----Intent.

His behaviour after the crime is inherent in the crime itself, and the jury will look upon his actions as one of a man guilty as hell.

The jury has the transcript of the tape and the tape itself. They can listen to all , bits, one particular bit, over and over again. .. they will draw their own conclusions, they are obliged to do that, and the voice of Holt will fade as much as the voice of Cash.

The defence of Gabe Tostee relied exclusively on Tostee's version of the recorded evening. No other defence was presented, and the jury is entitled to take that into consideration as to the value and integrity of the tape itself, and the spontaneity of the recorder himself during his participation.
 
Guilty for Manslaughter

(Would prefer a guilty murder charge but the prosecution has been weak)

I would like to see guilty for murder, but would settle for manslaughter.
 
I believe the jury will find him guilty of manslaughter and his time serving will be relatively brief.
However, IMO he might face civil actions in the future and if free he will definitely re-offend, because as so many have noted, he is a hopeless psycho.
 
Guilty - Manslaughter.....Although I'm afraid he may get off because of weak prosecution.....poll results showing 'Guilty - Manslaughter' well in front.
 
Hi All
If you remember the Lisa Harnum murder case, you probably have noted how hard it was to prove that Simon Gittany actually pushed his girlfriend off the balcony. There was a witness who saw it in a day light, there was a cctv recording of Gittany pushing Lisa in the lift, and only that helped to convict him of the murder. In the case of Warriena, the Crown does not even allege that Tostee pushed her off the balcony. So the guilty of murder is unlikely in my view, and I am afraid it will be hard to convict him of manslaughter. I hope I am wrong.
 
I have a feeling that it will be a hung jury.

I would have liked a murder conviction but the evidence may not be strong enough so I voted manslaughter. However, I think it could be a hung jury. I also think they should have just gone for manslaughter in the first place to avoid a "not guilty" verdict as juries can get confused with too many choices.
